Անտառապահի կողմից իր պարտականությունները պատշաճ չկատարելու արդյունքում ապօրինաբար 47 ծառ է հատվել

ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչության Թումանյանի քննչական բաժնում ավարտվել է Դսեղի անտառպետության անտառապահի կողմից պաշտոնեական անփութություն կատարելու դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննությունը:

Քրեական վարույթով կատարված նախաքննությամբ հիմնավորվել է, որ «Հայանտառ» ՊՈԱ կազմակերպության «Թումանյանի անտառտնտեսություն» մասնաճյուղի Դսեղի անտառպետության 2-րդ պահաբաժնի անտառապահը, ի պաշտոնե պարտավոր լինելով իրականացնել կանխարգելիչ միջոցառումներ և հսկողություն՝ ապօրինի անտառահատումների ու ՀՀ անտառային օրենսդրության այլ խախտումների նկատմամբ, իր ծառայության նկատմամբ անբարեխիղճ և անփույթ վերաբերմունք դրսևորելով՝ իր վրա դրված պարտականությունները պատշաճ չի կատարել:

Մասնավորապես՝ նա նշված պահաբաժնում պարբերաբար շրջայցեր չի իրականացրել, ամենամսյա հաշվետվություններ և ապօրինի ծառահատում կատարվելու վերաբերյալ անտառխախտման արձանագրություններ չի կազմել, չի ստուգել անտառօգտագործման իրավունք ընձեռող փաստաթղթերն ու հսկողություն չի սահմանել անտառօգտագործողների կողմից դրանց կատարման նկատմամբ:

Արդյունքում՝ 2021 թվականի նոյեմբերի 30-ից մինչև 2022 թվականի ապրիլի 26-ն ընկած ժամանակահատվածում «Հայանտառ» ՊՈԱ կազմակերպության «Թումանյանի անտառտնտեսություն» մասնաճյուղի Դսեղի անտառպետության 2-րդ պահաբաժնի 5-րդ քառակուսում գտնվող «Տանձուտի մոտ» կոչվող հանդամասում ապօրինի հատվել են ընդհանուր՝ 47 հատ բարդի, կաղնի և հացենի տեսակի կանգուն ծառեր։ Դրա հետևանքով կազմակերպության և պետության իրավունքներին ու օրինական շահերին անզգուշությամբ պատճառվել է էական՝ 2.442.000 ՀՀ դրամի վնաս:

Նշված 47 հատ ծառերերի հատումը հայտնաբերվել և արձանագրվել են միայն «Հայանտառ» ՊՈԱԿ-ի աշխատակիցների կողմից նշված տարածքում իրականացված վերստուգման ժամանակ:

Ձեռք բերված փաստերի հիման վրա անտառապահին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 446-րդ հոդվածի 1-ին մասով: Որպես խափանման միջոց նրա նկատմամբ ընտրվել է բացակայելու արգելքը:

Պետությանը պատճառված վնասի վերականգնման իրավական երաշխիքներ ապահովելու նպատակով մեղադրյալի շարժական գույքերի նկատմամբ կիրառվել է կալանք։

Նախաքննությունն ավարտվել է, և քրեական վարույթի նյութերը, մեղադրական եզրակացությամբ, ուղարկվել են դատարան:

Ծանուցում. հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանվծկարգով դատարանի` օրինական ուժի մեջ մտած դատավճռով:
