Արցախից պաշտոնական հաղորդագրություն ստացվեց

Արցախի Հանրևապետության ԱԳՆ-ն հայտարարություն է տարածել Ադրբեջանի կողմից Լաչինի միջանցքով ԿԽՄԿ մեքենաների տեղաշարժը խոչընդոտելու վերաբերյալ:
Հայտարարությունում մասնավորապես ասվում է.
«Հուլիսի 11-ին ադրբեջանական կողմը հերթական անգամ արգելել է Կարմիր խաչի միջազգային կոմիտեի (ԿԽՄԿ) տրանսպորտային միջոցների տեղաշարժը Լաչինի միջանցքում ապօրինաբար տեղադրված հսկիչ անցակետով՝ դրանով իսկ կոպտորեն խախտելով ինչպես միջազգային հումանիտար իրավունքի նորմերը, այնպես էլ 2020 թ․ նոյեմբերի 9-ի Եռակողմ հայտարարությամբ ստանձնած պարտավորությունները և ՄԱԿ-ի միջազգային դատարանի 2023 թ․ փետրվարի 22-ի ու հուլիսի 6-ի որոշումները։ Այն փաստը, որ այդ ապօրինի և անմարդկային գործողությունն արդարացնելու համար Ադրբեջանը հղում է անում ԿԽՄԿ-ին պատկանող մեքենաներով այնպիսի «չթույլատրված իրերի» տեղափոխմանը, ինչպիսիք են՝ բջջային հեռախոսներն ու աքսեսուարները, ծխախոտն ու վառելիքը, միայն ապացուցում է Արցախի շարունակվող տրանսպորտային, պարենային և էներգետիկ շրջափակումը, առաջին անհրաժեշտության ապրանքների սուր պակասը, ինչպես նաև Բաքվի թշնամական և մարդատյաց վերաբերմունքն Արցախի ժողովրդի նկատմամբ։
Կրկին ընդգծում ենք, որ միջազգային հումանիտար իրավունքի նորմերի համաձայն՝ Ադրբեջանը պարտավոր է չխոչընդոտել հումանիտար բեռների մատակարարումը պաշարված Արցախ։ Տվյալ պարտավորության խախտումը հանդիսանում է Ժնևի կոնվենցիաների դրույթների լուրջ խախտում և որակվում որպես պատերազմական հանցագործություն։
Հաշվի առնելով դեպքի կապակցությամբ ԿԽՄԿ հուլիսի 11-ի հայտարարությունը՝ անհրաժեշտ է ընդգծել, որ Ադրբեջանի գործողություններն ուղղակիորեն խախտում են 2020 թվականի նոյեմբերի 9-ին Հայաստանի, Ադրբեջանի և Ռուսաստանի ղեկավարների կողմից ստորագրված Եռակողմ հայտարարությունը, որով, մասնավորապես, նախատեսվում էր Լաչինի միջանցքի գործունեության վերահսկողությունը վերապահել ՌԴ խաղաղապահ ուժերին՝ ապահովելու կապը Լեռնային Ղարաբաղի և Հայաստանի միջև, ինչպես նաև երաշխավորել Լաչինի միջանցքով քաղաքացիների, տրանսպորտային միջոցների և ապրանքների երկու ուղղություններով երթևեկության անվտանգությունը։ Ավելին, Ադրբեջանի կողմից Լաչինի միջանցքի արգելափակման շարունակումը ՄԱԿ-ի միջազգային դատարանի իրավաբանորեն պարտադիր երկու որոշումների խախտում է, որոնց համաձայն Ադրբեջանը պարտավոր է ապահովել մարդկանց և ապրանքների երկու ուղղություններով անխոչընդոտ տեղաշարժը Լաչինի միջանցքով։ Ընդգծում ենք, որ միջազգային դերակատարները Լաչինի միջանցքի հարցի շուրջ իրենց մոտեցումներում պետք է առաջնորդվեն ՄԱԿ-ի միջազգային դատարանի իրավաբանորեն պարտադիր որոշումներով։
