Իրանի և ՌԴ քաղաքացիները ապօրինի կերպով ձեռք են բերել խոշոր չափերի թմրամիջոցներ․ գործը դատարանում է

Իրանի Իսլամական Հանրապետության քաղաքացիներ Ա.Լու.-ն, Ս.Մ.-ն և Ռուսաստանի Դաշնության քաղաքացի Մ.Շ.-ն, ԻԻՀ մեկ այլ քաղաքացու՝ Ա.Լ.-ի օժանդակությամբ, ապօրինի կերպով ձեռք են բերել, պահել և իրացնելու նպատակով տեղափոխել առանձնապես խոշոր չափերի թմրամիջոց, հայտնում են ՀՀ գլխավոր դատախազությունից։
Նախաքննության ընթացքում պարզվել է, որ թմիամիջոցներ իրացնելու համար Ս.Մ.-ն Ա.Լու.-ի և Մ.Շ.-ի հետ համատեղ «Տելեգրամ» հավելվածում ստեղծել և վարել է խանութ-հարթակ:
Ս.Մ.-ն և Ա.Լու.-ն 2022 թվականի հուլիսի 4-ին Հայաստան ժամանած Իրանի երկու քաղաքացիներից՝ Հ.Ղ.-ից և Սա.Հ.-ից ապօրինի կերպով ձեռք են բերել 228,1725 գրամ հաշիշ տեսակի թմրամիջոց, 46,9189 գրամ մեթամֆետամին տեսակի թմրամիջոց, 5,8299 գրամ պսիլոցիբին տեսակի թմրամիջոց և 0,001481 գրամ լիզերգիդ (ԼՍԴ) տեսակի թմրամիջոց:
Ձեռքբերված թմրամիջոցներն ապօրինի կերպով պահել են իրենց փաստացի բնակության վայրում՝ Շիրակի մարզի Անի համայնքի Ձորակապ բնակավայրում գտնվող տանը:
2022 թվականի հուլիսի 29-ին, խմբի անդամները 19 փաթեթներում փաթեթավորված թմրամիջոցներն ապօրինի տեղափոխել են Գյումրի քաղաք: Մ.Շ.-ն Ա.Լ.-ի օժանդակությամբ հաշիշ տեսակի թմրամիջոցը կպչուն ժապավենով ամրացրել է Գյումրու Լալայան փողոցի 8-րդ հասցեում գտնվող շինության պատին և լուսանկարել տեղանքը՝ հետագայում թմրամիջոցը ձեռք բերող անձին տեղանքի մասին տեղեկություն տալու համար:
Մ.Շ.-ն և Ա.Լ.-ն Ոստիկանության ծառայողների կողմից ձերբակալվել են: Շիրակի մարզի Անի համայնքի Ձորակապ բնակավայրում գտնվող տանը հայտնաբերվել է իրացնելու նպատակով, ապօրինի կերպով պահված թմրամիջոցների մյուս մասը: Նույն օրը ոստիկանների կողմից ձերբակալվել են նաև Ա.Լու.-ն և Ս.Մ.-ն:
2023 թվականի հուլիսի 7-ին Ս.Մ.-ի, Ա.Լու.-ի, Մ.Շ.-ի, Ա. Լ.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 393-րդ հոդվածի 3-րդ մասի 2-րդ կետով (թմրամիջոցների, հոգեմետ (հոգեներգործուն) նյութերի, դրանց պատրաստուկների կամ դրանց համարժեք նյութերի (անալոգի) կամ դրանց ածանցյալների ապօրինի շրջանառությունն իրացնելու նպատակով կամ դրանք ապօրինի իրացնելը): Վերջիններիս նկատմամբ որպես խափանման միջոց կիրառված է կալանքը:
2023 թվականի հուլիսի 14-ին հսկող դատախազը հաստատել է մեղադրական եզրակացությունը և քրեական վարույթի նյութերի հետ հանձնել Շիրակի մարզի ընդհանուր իրավասության առաջին ատյանի դատարան:
