Հարգելի՛ դատավորներ,
2023 թվականի հուլիսի 19-ին կայանալու է դատավորների ընդհանուր ժողով, որի օրակարգում ի թիվս այլ հարցերի ներառված է նաև Բարձրագույն դատական խորհրդի դատավոր անդամի ընտրության հարցը:
Բարձրագույն դատական խորհրդի դատավոր անդամ ընտրելու և դատավորների անկախությունը երաշխավորող սահմանադրական մարմնի օրինական ձևավորման գործընթացը կրկին վտանգված է:
Թեկնածուների ընտրությունը օրենքի պահանջներին հակառակ սահմափակվել է՝ մասնավորապես, ոչ անկախ մարմին հանդիսացող Դատական դեպարտամենտը ծանուցել է բացառապես ՀՀ մարզերի դատարանների դատավորներին՝ կրկին անտեսելով խորհրդի անդամի չափանիշներին համապատասխանող Երևան քաղաքի քրեական դատարանի դատավորների՝ ընտրվելու, իսկ դատավորներին իրենց անկախությունը երաշխավորող պատշաճ մարմին ձևավորելու իրավունքը:

Ավելի վաղ՝ 2022 թվականի մարտի 22-ին ևս հայտարարվել էր Սահմանադրության համապատասխան Բարձրագույն դատական խորհուրդ ձևավորելու հնարավորությունը դեպարտամենտի կողմից խախտելու մասին:
Ուստի, կոչ ենք անում դատավորներին տեր կանգնել իրենց իրավունքներին և Սահմանադրության ճիշտ կիրառմանը՝ քանզի Դատական դեպարտամենտը չի կարող ըստ իր հայեցողության կամ այլոց թելադրմամբ մեկնաբանել, կանխորոշել և ձևավորել սահամանադրական անկախ մարմինը, որը պետք է երաշխավորի դատական իշխանության անկախությունը, իսկ վերոհիշյալ գործելաոճի բացասական հետևանքների կրողը դատավորներն են ու արդարադատության շահառուն՝ հանրությունը:
