ՀՀ քննչական կոմիտեի տնտեսական հանցագործությունների և մաքսանենգությունների քննության գլխավոր վարչությունում ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետի հատկանիշներով նախաձեռնված քրեական վարույթի շրջանակներում պարզվում են խաբեության դրսևորմամբ առանձնապես խոշոր չափերով մաքսային վճարները չվճարելու դեպքի հանգամանքները:
Այս մասին հայտնում են Քննչական կոմիտեից:
«Նախաձեռնված քրեական վարույթի քննության ընթացքում կատարված բազմածավալ վարութային և այլ ապացուցողական գործոողությունների, ինչպես նաև պետական եկամուտների կոմիտեի աշխատաիկցների հետ հահմատեղ ձեռնարկված միջոցառումների արդյունքում պարզվել է, որ Ս.Հ.-ն, հանդիսանալով «ԱՐԵՆ-ԳՐՈՒՊ» ՍՊ ընկերության լիազորված անձը և ընկերության փաստացի ղեկավարը, պետական բյուջե վճարման ենթակա առանձնապես խոշոր չափերով մաքսային վճարները չվճարելու նպատակով, խաբեության դրսևորմամբ, թաքցրել է հարկման օբյեկտը: Արդյունքում չի հաշվարկել և պետական բյուջե չի վճարել 170.897.286 ՀՀ դրամի չափով մաքսային վճարներ:
Մասնավորապես՝ Ս.Հ.-ն, պետական բյուջե վճարման ենթակա առանձնապես խոշոր չափերով մաքսային վճարները չվճարելու նպատակով, խաբեության դրսևորմամբ, այն է՝ Իրանի Իսլամական Հանրապետությունից օտարերկրյա իրավաբանական անձի հիմնարկի անվամբ, սակայն փաստացի «ԱՐԵՆ ԳՐՈՒՊ» ՍՊ ընկերության կողմից ՀՀ-ում իրացնելու համար, խախտելով ԵԱՏՄ մաքսային օրենսգրքի 6-րդ հոդվածի 2-րդ կետի և 56-րդ հոդվածի 7-րդ կետի դրույթները, առանց ներմուծված ապրանքների համար մաքսային վճարների հաշվարկման և վճարման, 2023 թվականի ապրիլի 15-ին թվով 11 տարանցման հայտարարագրերով Հայաստանի Հանրապետության տարածք է ներմուծել ընդհանուր 283.250կգ բեռ` սերուցք և կարագ՝ 700.000 ԱՄՆ դոլար մաքսային արժեքով: Այնուհետև, ԻԻՀ-ից ՀՀ բերված կարագի և սերուցքի համար, Ս.Հ.-ի ցուցումով, իրավասու մարմնին ներկայացվել են իրականությանը չհամապատասխանող փաստաթղթեր, համաձայն որոնց՝ իբրև թե նշված ապրանքները պատկանում են վերոնշյալ օտարերկրյա իրավաբանական անձին և նախատեսված են վերջինիս կարիքների համար։ Դրանց հիման վրա ՀՀ մաքսային մարմինը, առանց մաքսային վճարների գանձման, 2023թ․ ապրիլի 22-ին 700.000 ԱՄՆ դոլար մաքսային արժեքով 283.250կգ բեռը բաց է թողել՝ «թույլատրված» կարգավիճակով:
Արդյունքում, Ս.Հ.-ն, մաքսային վճարների հաշվարկման կամ վճարման պարտավորություն առաջացնող գույքի վերաբերյալ խեղաթյուրված տվյալներ ներկայացնելով, թաքցրել է հարկման օբյեկտը, ինչի հետևանքով չի հաշվարկվել և պետական բյուջե չի վճարվել 170.897.286 ՀՀ դրամի չափով մաքսային վճարներ, այդ թվում՝ 51.630.600 ՀՀ դրամի չափով մաքսատուրք, 119.266.686 ՀՀ դրամի չափով ԱԱՀ։
Նախաքննությամբ ձեռք բերված փաստերի հիման վրա վարույթն իրականացնող մարմինը հսկող դատախազին ներկայացրել է միջնորդություն՝ Ս.Հ.-ի նկատմամբ ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետով հանրային քրեական հետապնդում հարուցելու մասին, որը բավարարվել է, և վերջինիս ներկայացվել է մեղադրանք՝ ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետով:
Մեղադրյալ Ս.Հ.-ն ձերբակալվել է՝ դատարան ներկայացվելու համար։
Երևան քաղաքի ընդհանուր իրավասության քրեական դատարանը, բավարարելով վարույթն իրականցնող մարմնի միջնորդությունը, 22.07.2023թ․ որոշումով վերջինիս նկատմամբ որպես խափանման միջոց է կիրառել կալանավորումը՝ 2 ամիս ժամկետով։
