Կոմիտասի անվան զբոսայգում գտնվող օտարման ոչ ենթակա հողամասը վաճառվել է. նախաձեռնվել է քրվարույթ

Շենգավիթ վարչական շրջանի դատախազությունում, պետական (համայնքային) շահերի պաշտպանության հայց հարուցելու գործառույթի շրջանակում, ուսումնասիրվել է Երևան քաղաքի Կոմիտասի անվան զբոսայգու տարածքում գտնվող հողամասի կադաստրային գործը: Այս մասին տեղեկանում ենք ՀՀ Գլխավոր դատախազության պաշտոնական կայքից։
Ուսումնասիրությամբ պարզվել է, որ Երևանի քաղաքապետի 2004 թվականի ապրիլի 15-ի որոշմամբ՝ Արշակունյաց 28/11 հասցեում գտնվող 192 քմ մակերեսով հողամասն ընդգրկված է եղել ՀՀ հողային օրենսգրքի 60-րդ հոդվածի սահմանափակումների ցանկում (օտարման ոչ ենթակա տարածքներ), սակայն, հետագայում, առանց դրա նպատակային ու գործառնական նշանակության փոփոխության, Երևանի քաղաքապետի 2012 թվականի հոկտեմբերի 29-ի որոշմամբ՝ հողամասն ուղղակի վաճառքով օտարվել է քաղաքացի Ռ.Ա.-ին:
Կառավարության 2005 թվականի դեկտեմբերի 15-ի որոշմամբ հաստատված Երևան քաղաքի գլխավոր հատակագծի համաձայն՝ վերը նշված 192 քմ մակերեսով հողամասը գտնվում է հասարակական նշանակության կանաչ տարածքի գոտում։
Երևանի քաղաքապետարանի պաշտոնատար անձինք, խախտելով վերոնշյալ որոշումների, ինչպես նաև Հողային օրենսգրքի 60-րդ հոդվածի պահանջները՝ 2012 թվականի նոյեմբերի 23-ին մասնավորեցման ոչ ենթակա, համայնքային սեփականություն հանդիսացող՝ Կոմիտասի անվան զբոսայգում գտնվող հասարակական նշանակության 192 քմ մակերեսով հողամասը, սեփականության իրավունքով փոխանցել են Ռ.Ա.-ին՝ էական վնաս պատճառելով պետության (համայնքի) օրինական շահերին։
Նկատի ունենալով, որ ուսումնասիրության ընթացքում հայտնաբերվել է Երևանի քաղաքապետարանի պաշտոնատար անձանց կողմից առերևույթ հանցանք կատարելու դեպք՝ 2023 թվականի հուլիսի 18-ին դատախազի կողմից հանցանքի մասին հաղորդում է ներկայացվել Հակակոռուպցիոն կոմիտե:
2023 թվականի հուլիսի 21-ին Հակակոռուպցիոն կոմիտեում նախաձեռնվել է քրեական վարույթ՝ 18.04.2003 թվականին ընդունված Քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով (պաշտոնեական լիազորությունները չարաշահելը):
Շենգավիթ վարչական շրջանի դատախազությունը 2023 թվականի հուլիսի 26-ին Երևանի քաղաքապետի՝ 2012 թվականի հոկտեմբերի 29-ի որոշումը և դրա հետևանքները վերացնելու պահանջի մասին հայցադիմում է ներկայացրել ՀՀ վարչական դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
