Հարգելի՛ դատավորներ,

Դատավորների ինքնակառավարման միակ և օրենքով ամրագրված մարմինը` դատավորների ընդհանուր ժողովը, 2023 թվականի հուլիսի 19-ին, ներկա գտնվող դատավորների բացարձակ մեծամասնությամբ, բաց քվեարկությամբ, բացառիկ կամք դրսևորեց դեմ արտահայտվելով ՀՀ Սահմանադրությանը հակադրվող` դատավորների անկախության սկզբունքից չբխող և դրսից հրամցվող օրակարգին` հստակ արձանագրելով մի քանի կարևոր հանգամանքներ.

  • Որպես դատավորների ինքնակառավարման միակ և լեգիտիմ մարմին` դատավորների ընդհանուր ժողովն է կոչված ապահովվելու Սահմանադրությամբ և օրենքով ամրագրված դատարանների` ի դեմս դատավորների գործունեության արդյունավետ կառավարումը:
  • Դատական իշխանությանը բացառապես սպասարկելուն կոչված ոչ անկախ մարմին հանդիսացող Դատական դեպարտամենտը փորձել է կանխորոշել և սխալ է մեկնաբանել ԲԴԽ ձևավորման գործընթացը` տվյալ պահին ծանուցելով միայն ՀՀ մարզերի դատարանների դատավորներին, անտեսելով խորհրդի անդամի չափանիշներին համապատասխանող Երևան քաղաքի քրեական դատարանի դատավորների՝ ընտրվելու, իսկ դատավորներին իրենց անկախությունը երաշխավորող պատշաճ մարմին ձևավորելու իրավունքը: 
  • Դատական դեպարտամենտն իրավասու չէ կանխորոշել և նախընտրած եղանակով մեկնաբանել ԲԴԽ ձևավորման ընթացակարգը՝ սահմանափակելով դատավորների ընտրությունը:
  • Քվեարկությամբ ընդունվել է առաջարկ` ոչ արդյունավետ կամ դատավորների անկախությունը անտեսող վարքագիծ դրսևորած ԲԴԽ դատավոր անդամին ընդհանուր ժողովով հետ կանչելու նախագիծ պատրաստելու անհրաժեշտության մասին:

Մինչդեռ անտեսելով դատավորների ընդհանուր ժողովում բաց քվեարկությամբ արտահայտած դիրքորոշումը` նախորդ ժողովում արձանագրվածի տոտալ անտեսմամբ` առանց որևէ հարց քննարկելու, ժամկետներ պահպանելու և որևէ պատճառաբանության ու լեգիտիմ նպատակի, օգոստոսի 4-ին կրկին հրավիրվել է ընդհանուր ժողով այն օրակարգով, ինչը մերժվել էր դատավորների բացարձակ մեծամասնության կողմից:

Օգոստոսի 4-ի ժողովին ընդառաջ դատավորների նկատմամբ կարգապահական վարույթներ նախաձեռնելու, լիազորությունները դադարեցնելու, առաջխաղացման ցուցակներից հանելու սպառնալիքների ներքո հրամցվում է ժողովին պարտադիր մասնակցելու և նախընտրած թեկնածուին ընտրելու «օրակարգ», որն անշեղորեն վաղ թե ուշ, այլ գործողությունների հետ միասին, արժանանալու է իրավական գնահատականի և հետևանքների:
