2023 թվականի փետրվարի 9-ին Էրեբունի և Նուբարաշեն վարչական շրջանների քննչական բաժնում ձերբակալված անչափահաս Ռ.Տ.-ի, ՆԳՆ ոստիկանության Երևան քաղաքի վարչության Էրեբունու բաժնի քրեական հետախուզության բաժանմունքի ավագ օպերլիազոր Վ.Պ.-Ի և տվյալ քրեական վարույթով վկա Մ.Ե.-ի մասնակցությամբ քննչական գործողության կատարման ընթացքում Ռ.Տ-ի պաշտպան Մ.Ա.-ի վերաբերյալ հնչել են հեգնական արտահայտություններ:

Քննչական գործողության ավարտից հետո պաշտպան Մ.Ա.-ն, վկա Մ.Ե.-ին քննիչի աշխատասենյակից դուրս է հրավիրել և միջանցքում պարզաբանում պահանջել:

Վկա Մ.Ե.-ն բաժնի միջանցքում գտնվող՝ ՆԳՆ ոստիկանության Երևան քաղաքի վարչության Էրեբունու բաժնի պետի օպերատիվ գծով տեղակալ Ս.Ե.-ի, օպերլիազոր Վ.Պ.-ի և քննությամբ չպարզված այլ ծառայողների ներկայությամբ հերքել է ինչպես իր, այնպես էլ ոստիկանության մյուս աշխատակիցների կողմից Մ.Ա.-ի վերաբերյալ հեգնական արտահայտություն հնչեցնելու հանգամանքը:

Դրան ի պատասխան՝ Մ.Ա.-ն սեռական բնույթի հայհոյանք է հնչեցրել այն անձանց հասցեին, ովքեր իր վերաբերյալ նման արտահայտություն են արել: Այդ կապակցությամբ Մ.Ա.-ի և միջադեպին ներկա՝ ՆԳՆ ոստիկանության ծառայողների միջև վիճաբանություն է առաջացել: Վիճաբանության ընթացքում վկա Մ.Ե.-ն, Էրեբունու բաժնի պետի օպերատիվ գծով տեղակալ Ս.Ե.-ն և քննությամբ չպարզված՝ ՆԳՆ ոստիկանության այլ աշխատակիցներ՝ խմբի կազմում, ձեռքերով և ոտքերով հարվածներ են հասցրել պաշտպան Մ.Ա.-ի գլխի և մարմնի տարբեր հատվածներին՝ պատճառելով առողջության թեթև վնասի հատկանիշներ չպարունակող մարմնական վնասվածքներ։

Միջադեպին ներկա՝ ձերբակալված անչափահաս Ռ.Տ.-ի մյուս պաշտպան Է.Ա.-ն միջամտել է ծեծկռտուքին, սեռական բնույթի հայհոյանքներ հնչեցրել միջադեպին ներկա՝ ոստիկանության աշխատակիցների հասցեին: Դրանից հետո վկա Մ.Ե.-ն օպերլիազոր Վ.Պ.-ի և քննությամբ չպարզված՝ ՆԳՆ ոստիկանության այլ աշխատակիցների հետ միասին՝ խմբի կազմում, պատասխան հայհոյանքներ հնչեցնելով, հարվածներ են հասցրել պաշտպան Է.Ա.-ի դեմքի և մարմնի տարբեր հատվածներին՝ պատճառելով առողջության թեթև վնասի հատկանիշներ չպարունակող մարմնական վնասվածքներ։

2023 թվականի օգոստոսի 8-ին և օգոստոսի 9-ին դատախազը որոշումներ է կայացրել հարուցել հանրային քրեական հետապնդումներ քրեական վարույթով վկա Մ.Ե.-ի (2 դրվագ), Էրեբունու բաժնի պետի օպերատիվ գծով տեղակալ Ս.Ե.-ի և օպերլիազոր Վ.Պ.-ի նկատմամբ՝ Քրեական օրենսգրքի 195-րդ հոդվածի 2-րդ մասի 5-րդ կետով (մի խումբ անձանց կողմից ֆիզիկական ներգործությունը):

Մեղադրյալների նկատմամբ որպես խափանման միջոց է ընտրվել բացակայելու արգելքը, իսկ Ս.Ե-ի նկատմամբ՝ նաև պաշտոնավարման կասեցումը:

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
