ՀՀ քննչական կոմիտեի Գեղարքունիքի մարզային քննչական վարչության Վարդենիսի քննչական բաժնում ավարտվել է Գեղարքունիքի մարզի Լանջաղբյուր համայնքի նախկին ղեկավար Յ.Բ.-ի կողմից պաշտոնեական լիազորությունները չարաշահելու դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննությունը:

Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ Լանջաղբյուր համայնքի ղեկավարը, 2005թ. հոկտեմբերից մինչև 2021թ. դեկտեմբեր ամիսը զբաղեցնելով հիշյալ պաշտոնը, նախապես իմանալով, որ նույն համայնքի վարչական տարածքում հեռահաղորդակցական գործունեություն ծավալող երկու ընկերություններ ցանկանում են տեղակայել բջջային կայաններ և դրա համար կնքել հողի վարձակալության պայմանագրեր, շահադիտական դրդումներից ելնելով, իր պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով, կնոջ օժանդակությամբ, տարբեր ժամանակահատվածներում համայնքի ավագանու որոշումների հիման վրա՝  հասարակական կառուցապատման գործառնական նշանակություն ունեցող երկու հողամաս, «Հրապարակային սակարկությունների մասին» ՀՀ խախտմամբ, աճուրդով վաճառել է աճուրդի մասնակից` իր կնոջը: Այնուհետև, նշված հողամասերի նկատմամբ ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեում գրանցվել է վերջինիս սեփականության իրավունքը, հողամասերը վարձակալության են հանձնվել հիշյալ ընկերություններին՝ բջջային կայան տեղադրելու համար՝ մի դեպքում տարեկան 480.000, մյուս դեպքում՝ 720.000 ՀՀ դրամ վարձավճարով:

Արդյունքում, Լանջաղբյուր համայնքի նախկին ղեկավարի դիտավորյալ գործողությունների հետևանքով համայնքի օրինական շահերին անզգուշությամբ պատճառվել է առանձնապես խոշոր չափերի՝ ընդհանուրը 13.320.000 ՀՀ դրամ գույքային վնաս:

Ձեռք բերված բավարար փաստերի հիման վրա Լանջաղբյուր համայնքի նախկին ղեկավարին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 2-րդ մասի 2-րդ կետով (երկու դրվագ), իսկ վերջինիս կնոջը՝ ՀՀ քրեական օրենսգրքի 46-441-րդ հոդվածի 2-րդ մասի 2-րդ կետով (երկու դրվագ):

Նախաքննությունն ավարտվել է, քրեական վարույթի նյութերը, մեղադրական եզրակացությամբ, ուղարկվել են հսկող դատախազին՝ հաստատելու և դատարան ուղարկելու համար:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
