ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում ավարտվել է անչափահասներին ծանր մարմնական վնաս հասցնելու դեպքի առթիվ նախաձեռնված քրեական վարույթից անջատված մասով նախաքննությունը: Այդ մասին հայտնում են ՔԿ-ից:
2022 թվականի ապրիլի 11-ին՝ ժամը 21:45-ին, «Վանաձորի բժշկական կենտրոն» ՓԲ ընկերությունից հաղորդում է ստացվել այն մասին, որ ծակած-կտրած վնասվածքներով իրենց մոտ բուժօգնության են տեղափոխվել Վանաձոր քաղաքի երեք բնակիչներ, որոնցից երկուսը 17, մեկը՝ 18 տարեկան:
Դեպքի առթիվ նախաձեռնված քրեական վարույթի շրջանակներում իրականացված քննչական և վարութային անհետաձգելի գործողությունների արդյունքում պարզվել են երիտասարդների մարմնական վնասվածքներ ստանալու հանգամանքները, այդ թվում՝ դեպքի վայրը, շարժառիթը, ինչպես նաև՝ առերևույթ հանցագործություն կատարած անձանցից մեկի ինքնությունը, անհատականացվել վերջինիս գործողությունները, որոնց տրվել է համարժեք իրավական գնահատական:
Նախաքննության ընթացքում տվյալներ են ստացվել այն մասին, որ երիտասարդները հիշյալ վնասվածքները ստացել են 2022 թվականի ապրիլի 11-ին՝ ժամը 20։50-ի սահմաններում, Վանաձոր քաղաքի Նարեկացի փողոցին հարակից «Ատեկա» կոչվող տարածքում մի խումբ երիտասարդների միջև ծագած վիճաբանության ժամանակ:
Քննությամբ պարզվել և հիմնավորվել է, որ դեպքին նախորդող ժամանակահատվածում Վանաձոր քաղաքի 15-ամյա երկու պատանիների միջև տեղի է ունեցել վիճաբանություն, ինչի վերաբերյալ հետագա պարզաբանումների նպատակով երիտասարդները պայմանավորվել են հանդիպել նշված վայրում, որին մասնակցել է մի կողմից 8 անձ, ովքեր զբաղվում են «Գրեպլինգ» տեսակի մարզաձևով, և մյուս կողմից՝ 19 անձ:
Ձեռնարկված միջոցառումների արդյունքում պարզվել է հիվանդանոց տեղափոխված անձանցից մեկին՝ 18-ամյա երիտասարդին, ծանր մարմնական վնասվածք հասցրած անձանցից մեկի ինքնությունը, որը Վանաձոր քաղաքի 16-ամյա բնակիչ է:
Օրենքով սահմանված կարգով վարութային ու ապացուցողական այլ գոր-ծողություններով ձեռքբերված ապացույցների հիման վրա՝ վերջինիս մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 166-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել հսկողության հանձնելը:
Վերջինիս վերաբերյալ մասով նախաքննությոնն ավարտվել է, անջատվել առանձին վարույթում, և վարույթի նյութերը, մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու համար, ուղարկվել են հսկող դատախազին:
Մյուս երկու տուժածներին մարմնական վնասվածքներ հասցրած անձանց մասով նախաքննությունը շարունակվում է:
Ձեռնարկվում են անհրաժեշտ միջոցառումներ՝ ենթադրյալ հանցագործություն կատարած անձին/անձանց ինքնությունը պարզելու, նրանց գործողություններն անհատականացնելու և իրավական գնահատական տալու, ինչպես նաև՝ հանցագործության գործիքը/ գործիքները հայտնաբերելու ուղղությամբ:
Ծանուցում. հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի օրինական ուժի մեջ մտած դատավճռով:
