Ճանապարհային երթևեկության կանոնների նվազ խախտումների համար վարորդները չեն տուգանվի

Ճանապարհային երթևեկության կանոնների նվազ խախտումների համար ճանապարհային ոստիկանությունը վարորդներին տուգանելու փոխարեն կնախազգուշացնի: Այս մասին հունվարի 12-ին լրագրողների հետ հանդիպմանն ասաց ՀՀ ճանապարհային ոստիկանության իրավաբանական վարչության պետ Արմեն Չիլինգարյանը՝ ներկայացնելով «Վարչական իրավախախտումների մասին» ՀՀ օրենքում և հարակից օրենքներում կատարված փոփոխությունները: «Առաջին փոփոխություննեը վերաբերում են կանգ գծերին: Այսինքն, լուսացույցի կարմիր լույսի առկայության պայմաններում տրանսպորտային միջոցը պարտավոր է կանգ առնել հաստ հոծ գծերի առջև: Ավելացնեմ, որ կատարված փոփոխությունները ենթադրում են, որ նման խախտումները ունեն նվազ նշանակություն, սակայն չեն դադարում համարվել ճանապարհային երթևեկության խախտում: Վարորդներին առաջին հերթին կոչ ենք անում փորձել պահպանել ճանապարհային երթևեկության կանոնները: Եթե չի հաջողվել պահպանել կանոնները, մի փոքր անցել են գիծը, փոփոխությունները նախատեսում են, որ վարորդը կտուգանվի այն դեպքում, երբ նրա մեքենայի առջևի անիվներն ամբողջությամբ կհատեն այդ գիծը»,- «Արմենպրես»-ի հաղորդմամբ՝ ընդգծեց Չիլինգարյանը:

Հոծ գիծ խախտելու դեպքում ևս նախատեսված է կիրառել նախազգուշացումներ, եթե դա կատարվել է անկախ վարորդի կամքից: Չիլինգարյանը մանրամասնեց, որ հոծ գիծը խախտելու դեպքում վարորդը չի տուգանվի, եթե նա այդ գիծը խախտել է մեկ անիվով: «Այս դեպքում կլինի նվազ նշանակություն և տուգանք չի կիրառվի, սակայն եթե մեքենան երկու անիվով կհատի հոծ գիծը, այստեղ չի կարող լինել պատահականություն», - նշեց Արմեն Չիլինգարյանը:

Հանդիպակաց գոտի դուրս գալու դեպքում նվազ նշանակություն ունեցող խախտումը կհամարվի այն դեպքում, երբ տրանսպորտային միջոցի անիվներն ամբողջությամբ չեն հատել հոծ գիծը, այսինքն՝ ամբողջությամբ դուրս չեն եկել հանդիպակաց երթևեկության կողմը:

Արմեն Չիլինգարյանը չի բացառում, որ տեսանկարահանող սարքերի մոտ աշխատող մարդկանց  ծանրաբեռնվածության պատճառով կարող են լինել դեպքեր, որ վարորդները ոչ տեղին տուգանքների ենթարկվեն: «Եթե վարորդները կգտնեն, որ իրենք խախտում չեն արել և չպետք է տուգանվեն, ապա կարող են բոլոր հնարավոր եղանակներով բողոքարկել որոշումը, որից հետո ակտը կվերանայվի և կկայացվի համապատասխան որոշում»,- նշեց Արմեն Չիլինգարյանը:

Կանգառի կանոնների դրույթների խախտման ժամանակ ևս տուգանքներ չեն կիրառվի այն դեպքերում, երբ վարորդը կկանգնի մեկ րոպեով՝ ուղևոր իջեցնելու կամ վերցնելու համար: Արմեն Չիլինգարյանը ավելացրեց, որ վարորդները կարող են կանգնել միայն լայն փողոցներում, իսկ նեղ փողոցներում կանգնելը կհամարվի խախտում և կլինի համապատասխան տուգանք: «Վարորդները ուղևոր իջեցնելու կամ վերցնելու համար կարող են կարճ կանգառ կատարել միայն լայն փողոցներում: Եթե նման դեպքերում մեքենայից իջնի վարորդը, այս դեպքում ևս նա կտուգանվի, քանի որ օրենքում սահմանված է, որ կարճ կանÕ �առ թույլատրվում է միայն ուղևոր իջեցնելու կամ վերցնելու համար»,- հավելեց բանախոսը:
