44-օրյայի ժամանակ ՊԲ զորամասի հրամանատարի տեղակալը խաբեությամբ դադարեցրել է ծառայության պարտականությունների կատարումը

Պաշտպանության բանակի N զորամասի (դիվիզիայի) հրամանատարի բարոյահոգեբանական ապահովման գծով տեղակալ, գնդապետ Մ.Բ.-ն 2020 թվականի հոկտեմբերի 3-ին, աջ ծնկահոդի շրջանում վնասվածք ստանալու պատճառաբանությամբ, դիմել է Հադրութի շրջանի Տող գյուղում ծավալված Մեխակավանի զինվորական հոսպիտալ: Մ.Բ.-ի աջ ծնկահոդի հատվածում հայտնաբերվել է միայն այտուց, տեղադրվել է ֆիքսատոր՝ հոդի շարժունակությունը սահմանափակելու նպատակով:
Այս մասին հայտնում են ՀՀ գլխավոր դատախազությունից:
Վերադաս հրամանատարության կողմից Մ.Բ.-ին հանձնարարվել է շարունակել զինվորական ծառայության պարտականությունների կատարումը, մասնավորապես՝ Հադրութ քաղաքում գտնվող անձնակազմի հետ իրականացնել բարոյահոգեբանական աշխատանքներ: Գիտակցելով, որ առկա չէ իր առողջական վիճակով պայմանավորված զինվորական ծառայության պարտականությունների կատարումը դադարեցնելու հնարավորություն՝ Մ.Բ.-ն, մարտական գործողությունների ընթացքում վիրավորում ստացած լինելու պատրանք ստեղծելու նպատակով, աջ ծնկահոդի այտուցված հատվածը բազմակի անգամ մշակել է յոդ տեսակի հեղուկով, վիրակապել նույն հեղուկով խիտ թաթախված բինտով՝ աջ ծնկային հոդի շրջանում առաջացնելով 2-րդ աստիճանի այրվածք:
2020 թվականի հոկտեմբերի 10-ին՝ ժամը 11:00-ից մինչև 12:00-ն ընկած հատվածում, դիվիզիայի հրամանատարական կետի տեղափոխման ժամանակ, հակառակորդի կողմից հրետակոծության է ենթարկվել Մ.Բ.-ին ու համածառայողին տեղափոխող ավտոմեքենան: Հրետակոծության հետևանքով բեկորային վիրավորում է ստացել միայն վարորդը: Նույն ավտոմեքենայում գտնված, մարմնական որևէ վնասվածք չստացած Մ.Բ.-ն, օգտագործելով այն հանգամանքը, որ ոչ ոք տեղեկություն չունի իր վիճակի մասին, անձնակազմին տեղեկացրել է, թե իբր հրետակոծության արդյունքում վիրավորում է ստացել:
Մ.Բ.-ի վարքագծի հիման վրա՝ համածառայողները վերջինիս ուղարկել են «Հադրութի շրջանի բուժական միավորում» ՓԲԸ, իսկ 2020 թվականի հոկտեմբերի 10-ին Մ.Բ.-ն ազատվել է զբաղեցրած պաշտոնից:
2023 թվականի սեպտեմբերի 27-ին Մ.Բ.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ ռազմական դրության ժամանակ խաբեության եղանակով զինվորական ծառայությունը կամ դրա առանձին պարտականությունների կատարումը ժամանակավորապես դադարեցնելու համար:
2023 թվականի սեպտեմբերի 29-ին դատախազը հաստատել է մեղադրական եզրակացությունը և վարույթի նյութերի հետ հանձնել Սյունիքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
