Վարակիչ հիվանդության դեպքում անձի բժշկական օգնությունն ու սպասարկումը կիրականացվի անվճար. նախագիծ․ «Փաստ»

«Փաստ» օրաթերթը գրում է.
Առողջապահության նախարարությունն առաջարկում է լրացումներ և փոփոխություններ կատարել «Բնակչության բժշկական օգնության և սպասարկման մասին» օրենքում՝ տալով վարակիչ հիվանդության, հանրության համար վտանգավոր վարակիչ հիվանդության սահմանումները, ինչպես նաև լիազորել կառավարությանը սահմանել վերջինի ցանկը, որտեղ ներառված կլինեն բարձր վտանգ ներկայացնող հիվանդությունները, որոնք հիմք կհանդիսանան մարդու իրավունքների սահմանափակման համար: Նշվում է, որ օրենքում բացակայում է շրջապատի համար վտանգ ներկայացնող հիվանդությունների սահմանումը, արդյունքում բացակայում են ցանկում ընդգրկվելու չափանիշները, որոնք էլ կիրառական դաշտում առաջացնում են քաղաքացիների իրավունքների սահմանափակումներ:
«ՀՀ բնակչության սանիտարահամաճարակային անվտանգության ապահովման մասին» օրենքում լայնորեն կիրառվում է «վարակիչ հիվանդություն» ձևակերպումը, որի սահմանումը օրենքում տրված չէ: Ըստ նախարարության՝ ներկայում գործում են մի շարք իրավական ակտեր, որոնք այս կամ այն սահմանափակումներ են նախատեսում անձանց համար, որոնք ունեն «շրջապատի համար վտանգ ներկայացնող հիվանդություններ», թեև հիվանդությունների ցանկում ներառված են լայնորեն տարածված բազմաթիվ հիվանդություններ, որոնց առկայության դեպքում մարդու հանդեպ սահմանափակումների կիրառումը հիմնավորված չէ: Տվյալները վկայում են, որ գործող իրավական ակտերում առկա ձևակերպումները կարող են առաջացնել քաղաքացիների իրավունքների և ազատությունների չհիմնավորված սահմանափակումներ:
Հետևաբար, առաջարկվում է դրանք վերացնելու և զուգահեռաբար վարակիչ հիվանդություններ ունեցող անձանց անվճար բժշկական օգնություն և սպասարկում ապահովելու նպատակով՝ «Բնակչության բժշկական օգնության և սպասարկման մասին» օրենքում, ինչպես նաև հարակից իրավական ակտերում սահմանել Սահմանադրությունից բխող «հանրության համար վտանգավոր վարակիչ հիվանդությունների» ձևակերպում, ցանկը կհաստատի կառավարությունը, դրանք հիմք կհանդիսանան անձի ազատությունները սահմանափակելու համար: Զուգահեռաբար քաղաքացիների անվճար բժշկական օգնության իրավունքը պահպանելու համար առաջարկվում է նույն օրենքում սահմանել վարակիչ հիվանդության սահմանումը, որոնց առկայության դեպքում անձանց բժշկական օգնությունն ու սպասարկումը կիրականացվի անվճար:
