Լեւոն Քոչարյանի պաշտպան Էրիկ Ալեքսանյանը բաց նամակ է հղել ՀՀ գլխավոր դատախազին Լեւոն Քոչարյանի գործով․
«Հարգելի, տիկին Վարդապետյան
հարկ է նկատել, որ եթե առաջնորդվենք այն կանխավարկածով, որ միայն ենթադրյալ ծեծից տուժած անձի ցուցմունքը բավարար է ոչ միայն քրեական վարույթ նախաձեռնելու, այլև քրեական հետապնդում հարուցելու համար, ընդ որում՝ բոլորովին էլ պարտադիր չլինելով ի սկզբանե դատաբժշկի եզրակացության առկայությունը, ապա այդ դեպքում ինչպես է ստացվել, որ Լևոն Քոչարյանին ծեծի ենթարկելու փաստի առթիվ նախաձեռնվել է քրեական վարույթ, սակայն նրան ծեծի ենթարկած ոստիկանության աշխատակիցների նկատմամբ հանրային քրեական հետապնդում հարուցելու մասին որոշում չի կայացվել, այն պարագայում, երբ առկա է ոչ միայն Լևոն Քոչարյանի ցուցմունքն իրեն ծեծի ենթարկելու, ինպես նաև բժշկական տեղեկանքներ՝ վերջինիս կողմից մարմնական վնասվածքներ ստանալու վերաբերյալ, այլև առկա են բազմաթիվ տեսագրություններ, որոնք վկայում են Լևոն Քոչարյանի նկատմամբ բռնի գործողություններ կատարելու հանգամանքի մասին, որոնք ի դեպ հերքում են հակառակը՝ Լևոն Քոչարյանի կողմից տուժող Հրաչիկ Խաչատրյանին մինչ ավտոմեքենա նստելը ձախ ոտքին հարվածներ հասցնելու հանգամանքը։
Ճիշտ է, թեև այն քրեական վարույթը, որի շրջանակներում Լևոն Քոչարյանը հանդիսանում է տուժող չի հանդիսանում սույն քրեական վարույթի առարկան, միևնույնն է պաշտպանական կողմը համամետական անցկանելով պարզապես ցանկանում է արձանագրել քրեական հետապնդման մարմինների տարբերակված մոտեցումը։ Մի դեպքում միայն շահագրգիռ անձի /ոստիկան-տուժողների, ոստիկան-վկաների/ ցուցմունքները բռնություն գործադրելու վերաբերյալ բավարար են քրեական հետապնդում հարուցելու, իսկ հետագայում նաև կալանքը որպես խափանման միջոց կիրառելու վերաբերյալ դատարան միջնորդություն ներկայացնելու համար, իսկ մյուս դեպքում՝ մեկ այլ շահագրգիռ անձի /Լևոն Քոչարյան-տուժող կարգավիճակով/ ցուցմունքն իրեն ծեծելու և խոշտանգելու վերաբերյալ, որն ի տարբերություն առաջին օրինակի՝ ամրապնդված է բժշկական տեղեկանքներով, ինչպես նաև տեսագրություններով՝ բավարար չէ ոստիկանության աշխատակիցների նկատմամբ նույնիսկ քրեական հետապնդում հարուցելու մասին որոշման կայացման համար։
