Ընկերության սեփականատերը ՊՆ-ից հափշտակել է 59 մլն 582 հազար դրամ

«Մոսէսքո» ՍՊ ընկերության սեփականատեր Կ.Գ.-ն 2017 թվականին Պաշտպանության նախարարության կարիքների համար ներկրվող նյութական միջոցների ընդունման հանձնաժողովի նախագահ, N զորամասի հրամանատար Ռ.Բ.-ի, Հանձնաժողովի անդամներ՝ հրամանատարի տեղակալ-գլխավոր ինժեներ Ա.Պ.-ի, Վառելիքաքսուքային նյութերի պահպանման բաժնի պետ Ա.Ա.-ի և պահեստապետ Ս.Կ.-ի օժանդակությամբ, Պաշտպանության նախարարությունից հափշտակել է 59 մլն 582 հազար 840 դրամ:
Բացի այդ, Կ.Գ.-ն պատրաստել և օգտագործել է կեղծ փաստաթղթեր, օժանդակել է Հանձնաժողովի անդամների և պահեստապետի կողմից պաշտոնեական կեղծիք կատարելուն:
Մասնավորապես՝ 2017 թվականի հուլիսի 4-ին «Մոսէսքո» ՍՊ ընկերության և Պաշտպանության նախարարության միջև կնքվել է 94 մլն 320 հազար դրամով 240 տոննա հակասառիչ նյութի մատակարարման պայմանագիր:
Պայմանագրով Ընկերությունը պարտավորվել է սահմանված կարգով և ժամանակացույցով 80 հազար կիլոգրամը մատակարարել 2017 թվականի հուլիսին, իսկ 160 հազար կիլոգրամը՝ 2017 թվականի 3-րդ եռամսյակում:
Համաձայն «Մոսէսքո» ՍՊ ընկերության և Պաշտպանության նախարարության համապատասխան ստորաբաժանումների կողմից կազմված փաստաթղթերի՝ վերոնշյալ պայմանագրի հիման վրա «Մոսէսքո» ՍՊ ընկերությունը 2017 թվականին իբր մատակարարել է 240 հազար կիլոգրամ հակասառիչ նյութ, մինչդեռ «Մոսէսքո» ընկերությունը 2017 թվականին Հայաստանի
Հանրապետություն է ներմուծել 116 հազար 900 կիլոգրամ հակասառիչ նյութ, որից Պաշտպանության նախարարությանը մատակարարվել է 105 հազար 810 կիլոգրամը (105 հազար 810 կիլոգրամից 20 հազար 790 կիլոգրամը հետ է վերադարձվել):
«Մոսէսքո» ՍՊ ընկերությունը 2017 թվականին Հայաստանի Հանրապետության տարածքում մատակարարման ենթակա հակասառիչ նյութի ձեռքբերում չի ունեցել:
Չնայած այն հանգամանքին, որ Ընկերությունը Պաշտպանության նախարարությանն իրականում չի մատակարարել նախատեսված 240 հազար կիլոգրամից 154 հազար 980 կիլոգրամը՝ Հանձնաժողովի նախագահ՝ Զորամասի հրամանատար Ռ.Բ.-ն, Հանձնաժողովի անդամներ Ա.Պ.-ն, Ա.Ա.-ն և Ս.Կ.-ն, շահադիտական նպատակով, կազմել և ստորագրել են կեղծ փաստաթղթեր՝ Ընկերության կողմից զորամասին 154 հազար 980 կիլոգրամ հակասառիչ նյութ մատակարարված լինելու վերաբերյալ:
Արդյունքում՝ Կ.Գ.-ն, Հանձնաժողովի նախագահ, Զորամասի հրամանատար Ռ.Բ.-ի, անդամներ՝ հրամանատարի տեղակալ-գլխավոր ինժեներ Ա.Պ.-ի, Վառելիքաքսուքային նյութերի պահպանման բաժնի պետ Ա.Ա.-ի և պահեստապետ Ս.Կ.-ի օժանդակությամբ, Պաշտպանության նախարարությունից խարդախությամբ հափշտակել է առանձնապես խոշոր չափերի՝ 59 մլն 582 հազար 840 դրամ:
Դատախազը 2023 թվականի հոկտեմբեր 16-ին Կ.Գ.-ի նկատմամբ հարուցել է հանրային քրեական հետապնդում՝ 18.04.2003 թվականին ընդունված Քրեական օրենսգրքի 178-րդ հոդվածի 3-րդ մասի 1-ին կետով (առանձնապես խոշոր չափերով խարդախություն), 325-րդ հոդվածի 1-ին մասով (փաստաթղթեր կեղծելը, իրացնելն ու օգտագործելը), 38-314-րդ հոդվածի 1-ին մասով (պաշտոնեական կեղծիք կատարելուն օժանդակելը), Ռ.Բ.-ի նկատմամբ՝ 38-178-րդ հոդվածի 3-րդ մասի 1-ին կետով, 314-րդ հոդվածի 1-ին մասով, Ա.Պ.-ի նկատմամբ՝ 38-178-րդ հոդվածի 3-րդ մասի 1-ին կետով, 314-րդ հոդվածի 1-ին մասով, Ա.Ա.-ի նկատմամբ՝ 38-178-րդ հոդվածի 3-րդ մասի 1-ին կետով, 314-րդ հոդվածի 1-ին մասով, Ս.Կ.-ի նկատմամբ՝ 38-178-րդ հոդվածի 3-րդ մասի 1-ին կետով, 314-րդ հոդվածի 1-ին մասով:
Դատախազը 2023 թվականի հոկտեմբերի 19-ին հաստատել է մեղադրական եզրակացությունը և վարույթի նյութերի հետ հանձնել Հակակոռուպցիոն դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
