Վարչական պատասխանատվություն կկիրառվի պետական գաղտնիք պարունակող տեղեկությունների պահպանության բնագավառի օրենսդրության պահանջները չկատարելու համար. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Ազգային անվտանգության ծառայությունն առաջարկում է փոփոխություններ և լրացումներ կատարել «Վարչական իրավախախտումների վերաբերյալ» օրենքում, մասնավորաբար՝ վարչական պատասխանատվություն սահմանել «Պետական գաղտնիքի մասին» օրենքով և օրենքից բխող կառավարության որոշումներով սահմանված պահանջների խախտման համար:
ՀՀ քրեական և Վարչական իրավախախտումների վերաբերյալ օրենսգրքերով նախատեսված՝ պետական գաղտնիքի պահպանության ոլորտին առնչվող իրավախախտումների շրջանակի ուսումնասիրման արդյունքում պարզ է դառնում, որ պետական գաղտնիքի պահպանության ոլորտում օրենսդրությամբ հիմնականում պատասխանատվություն է նախատեսված տարբեր սուբյեկտների կողմից կամ տարբեր եղանակներով պետական գաղտնիք պարունակող տեղեկությունների հրապարակման համար: Միևնույն ժամանակ, օրենսդրությամբ վարչական պատասխանատվության որևէ միջոց նախատեսված չէ պետական գաղտնիք պարունակող տեղեկությունների պահպանության բնագավառի օրենսդրության պահանջները չկատարելու համար:
«Պետական գաղտնիքի մասին» օրենքի 24րդ հոդվածի համաձայն՝ ԱԱԾ-ն պետական և տեղական ինքնակառավարման մարմիններում, կազմակերպություններում ու իրավաբանական անձանց մոտ ստուգումների միջոցով իրականացնում է գաղտնիության ռեժիմի ապահովման միջգերատեսչական վերահսկողություն, որի նպատակն է գաղտնիության ռեժիմի ապահովման փաստացի վիճակի ուսումնասիրումն ու գնահատումը, թերությունների և խախտումների հայտնաբերումը, դրանց պատճառների ճշտումը, վերացումն ու կանխումը: Չնայած սրան՝ օրենսդրությամբ նախատեսված չէ որևէ գործիք ԱԱԾ-ի կողմից իրականացվող ստուգումների արդյունքում թերությունների և խախտումների հայտնաբերման դեպքում համապատասխան կազմակերպություններին, իրավաբանական անձանց կամ գաղտնիության ռեժիմի ապահովման համար պատասխանատու պաշտոնատար անձանց պատասխանատվության ենթարկելու համար:
Ըստ ԱԱԾ-ի, գաղտնիության ռեժիմի ապահովման ուղղությամբ բազմաբնույթ խախտումներ են հանդիպում ինչպես պետական և տեղական ինքնակառավարման մարմիններում, այնպես էլ կազմակերպություններում ու իրավաբանական անձանց մոտ: «Պետական գաղտնիքի մասին» օրենքն ամբողջ ծավալով ուժի մեջ կմտնի 2024 թ. հունվարի 28-ից։
