Ի՞նչ հիմնավորումներով է «Հայաքվեի» օրինագիծը քննարկվելու ԱԺ-ում. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Ինչպես հայտնի է, «Հայաքվեի» նախաձեռնած՝ Արցախի վերաբերյալ օրինագիծը օրեր առաջ պաշտոնապես մուտքագրվեց ԱԺ: Նախագիծը օրենքով սահմանված 50 000 ստորագրությունից ավելի էր հավաքել՝ 58000, իսկ ԿԸՀ-ն հաստատել էր ներկայացված ստորագրությունների վավերականությունը: Մոտ մեկ ամիս շրջանառության մեջ մնալուց հետո կքննարկվի գլխադասային հանձնաժողովում, բայց անկախ վերջինիս եզրակացությունից, նախագիծն ընդգրկվելու է ԱԺ լիագումար նիստերի օրակարգ: «Փաստ» թերթի տեղեկություններով, «Հայաքվեի» նախաձեռնողները բավական հիմնավոր են պատրաստվել խորհրդարանական քննարկումներին:
Մեր աղբյուրների փոխանցմամբ, մասնավորաբար ԱԺ-ում ներկայացվելու են հիմքեր, որ Արցախի Հանրապետությունը իրավաբանորեն պահպանում է իր գոյությունը, իսկ ԱՀ նախագահի՝ հանրապետության լուծարման մասին հրամանագիրն առոչինչ է, չունի իրավաբանական ուժ, ստորագրվել է ժողովրդի բնաջնջման սպառնալիքի ներքո: Հաջորդ թեզերը վերաբերելու են նրան, որ Հայաստանի Հանրապետությունը պարտավոր է Արցախի կարգավիճակն Ադրբեջանի կազմում կանխորոշող որևէ փաստաթուղթ չստորագրել, իսկ ՀՀ կողմից Արցախն Ադրբեջանի մաս չճանաչելը սահմանադրական պահանջ է։ Մեր տեղեկություններով, հատուկ շեշտադրում է կատարվելու այն հանգամանքին, որ օրենքի նախագծի ընդունումը միտված է ՀՀ-ում ժողովրդավարության ապահովմանը, ՀՀ ինքնիշխանության պաշտպանությանը:
Նախաձեռնողների կարծիքով, Ազգային ժողովի պատգամավորների սահմանադրական պարտքն է ընդունել առաջարկվող նախագիծը, հակառակ դեպքում, ՀՀ-ում քաղաքական իշխանության փոփոխությունից հետո նրանց սպառնալու է ազատազրկում՝ 10-15 տարի ժամկետով։ Հավելենք, որ, ըստ նախագծի հեղինակների, Հայաստանը հանգիստ կարող է հիմա հետ կանգնել նախկին Ադրբեջանական ԽՍՀ սահմաններում Ադրբեջանի տարածքային ամբողջականության ճանաչելու վերաբերյալ հայտարարությունից, քանի որ դա արվել է փոխադարձ պայմանավորվածությամբ, որ Ադրբեջանն ապահովելու է Արցախի ժողովրդի իրավունքներն ու անվտանգությունը, ինչը չի արվել։ Հիշեցնենք, որ «Հայաքվե» նախաձեռնությունն առաջարկում է երկու լրացում կատարել Քրեական օրենսգրքում և 10- 15 տարվա ազատազրկման պատիժ սահմանել ոչ միայն Հայաստանի անունից Արցախը Ադրբեջանի մաս ճանաչելու, այլև Հայոց ցեղասպանությունը ժխտելու կամ դրա նշանակությունը նսեմացնելու համար:
