55 միլիոն դրամի վճարում՝ առանձնապես խոշոր չափերով հարկերից խուսափելու վերաբերյալ քրեական վարույթով

Բացահայտվել է տնտեսվարող սուբյեկտի կողմից առանց հաշվարկային փաստաթղթերի տրամադրման ապրանքներ իրացնելու, առանձնապես խոշոր չափերով հարկեր չվճարելու ևս մեկ դեպք։
ՀՀ քննչական կոմիտեի տնտեսական հանցագործությունների և մաքսանենգությունների քննության գլխավոր վարչությունում քննվող քրեական վարույթներից մեկի նախաքննությամբ իրականացված քննչական և ապացուցողական գործողությունների, ՀՀ ՊԵԿ հետաքննության և օպերատիվ հետախուզության վարչության աշխատակիցների ձեռնարկած համալիր օպերատիվ-հետախուզական միջոցառումների և հարկային տեղեկատվության և ռիսկերի վերլուծության վարչության աշխատակիցների իրականացրած ուսումնասիրությունների արդյունքում փաստական տվյալներ են ստացվել այն մասին, որ Վ․Դ-ն, հանդիսանալով 2015թ․ սեպտեմբերի 11-ին պետական գրանցում ստացած «Արտմոդա», «Արտշուզ» անվանումով խանութներում հագուստի և կոշիկի մանրածախ առևտրով զբաղվող ընկերության 100 տոկոս բաժնեմասի սեփականատերը և տնօրենը, տարբեր ժամանակահատվածներում հագուստի, կոշիկի մանրածախ առևտուր իրականացրած և նույն անվան ներքո գործած անհատ ձեռնարկատեր Ա․Խ․-ի գործունեությունը փաստացի ղեկավարած անձ, «Հաշվապահական հաշվառման մասին» ՀՀ օրենքի 8-րդ հոդվածի ու ՀՀ հարկային օրենսգրքի 33-րդ հոդվածի համաձայն պատասխանատու լինելով ընկերության հաշվապահական հաշվառումը կազմակերպելու, հարկային օրենսդրությամբ նախատեսված հաշվետվություններ, հաշվարկներ, հարկման հիմք հանդիսացող այլ փաստաթղթեր ու տեղեկություններ սահմանված ժամկետում հարկային մարմին ներկայացնելու, հարկերը ճիշտ և ինքնուրույն հաշվարկելու, ժամանակին վճարելու ու հարկային օրենսդրության մյուս պահանջները պահպանելու համար, հարկեր չվճարելու նպատակով, խախտելով ՀՀ հարկային օրենսգրքի պահանջները, 2020 թվականից 2023 թվականի փետրվար ամիսը ներառյալ թաքցրել է ընկերության հարկման օբյեկտը։
Մասնավորապես՝ վաճառքներ իրականացնելիս գնորդներին չի տրամադրել հսկիչ դրամարկղային մեքենայի կտրոններ և հարկային հաշվարկներում մտցրել է խեղաթյուրված տվյալներ, ինչպես նաև, որպես Ա/Ձ Ա․Խ․-ի գործունեությունը փաստացի ղեկավարող անձ, 2020-2022 թվականների ընթացքում վերջինիս միջոցով նույն եղանակով թաքցրել է անհատ ձեռնարկատիրոջ հարկման օբյեկտները։ Արդյունքում պետական բյուջե չի վճարել առանձնապես խոշոր չափերով հարկեր։
Քրեական վարույթով ձեռք բերված բավարար փաստերի հիման վրա Վ․Դ-ի նկատմամբ ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետով հարուցվել է քրեական հետապնդում և վերջինիս ներկայացվել է մեղադրանք։
Ներկայացված մեղադրանքում Վ․Դ-ն իրեն մեղավոր է ճանաչել, հարկային մարմին է ներկայացրել ճշտված հարկային հաշվարկներ և պարտավորվել է վճարել նախկինում թաքցված շուրջ 100․000․000 ՀՀ դրամի հարկային պարտավորություն, որից նախաքննության ներկա փուլում պետական բյուջե է վերականգնել շուրջ 55․000․000 ՀՀ դրամը։
