ԵԱՀԿ ԽՎ-ում հայկական պատվիրակության ղեկավար Սարգիս Խանդանյանը կարևորեց ՄԱԿ-ի արդարադատության միջազգային դատարանի որոշումը՝ Հայաստանն ընդդեմ Ադրբեջանի գործով։  Խանդանյանն այս մասին հայտարարեց լրագրողների հետ ճեպազրույցում։

«Շատ կարևոր է ՄԱԿ-ի արդարադատության միջազգային դատարանի այս որոշումը և շատ կարևոր է, որ այն երկրները, որոնք մաս են կազմում այդ դատարանի, լսեն, հետևեն, դատարանի որոշումներին։

Ցավով պետք է արձանագրեմ, որ Արդարադատության միջազգային դատարանը նման որոշում էր կայացրել նաև Լաչինի միջանցքի բացման վերաբերյալ, բայց միջազգային հանրություն ճնշումը բավարար չեղավ։ 

Բայց կրկին ողջունում եմ այդ որոշումը և հույս ունեմ, որ դա նաև դիվանագիտական և քաղաքական գործընթացում կարևոր գործիք կարող է լինել»,- ասաց Խանդանյանը։

ՄԱԿ-ի Արդարադատության միջազգային դատարանը նոյեմբերի 17-ին  հրապարակել րէ միջանկյալ միջոց կիրառելու վերաբերյալ ՀՀ հայցն ընդդեմ Ադրբեջանի գործով որոշումը։

Դատարանն Ադրբեջանին պարտավորեցրել է ապահովել 2023 թվականի սեպտեմբերի 19-ից հետո Լեռնային Ղարաբաղից հեռացած և վերադառնալ ցանկացող անձանց անվտանգ, անխոչընդոտ և արագ վերադարձը։

Բացի այդ, Միջազգային դատարանի որոշման համաձայն, Ադրբեջանը պարտավոր է ապահովել, որպեսզի այն անձինք, ովքեր դեռևս Լեռնային Ղարաբաղում են 2023 թվականի սեպտեմբերի 19-ից հետո և ցանկանում են հեռանալ, կարողանան դա անել անվտանգ առանց խոչընդոտների և արագորեն։

Մյուս կետով դատարանն Ադրբեջանին պարտավորեցրել է սեպտեմբերի 19-ից հետո ԼՂ-ում մնացած կամ վերադարձած անձանց զերծ պահել ուժի գործադրումից և ահաբեկումից։

Ադրբեջանը պարտավոր է Կոնվենցիայի համաձայն իր ունեցած պարտավորությունների շրջանակում պահպանել և պաշտպանել գրանցման, ինքնության և անձնական գույքի փաստաթղթերը և գրանցման մատյանները, հիմք ընդունել դրանք իր վարչական, օրենսդրական պրակտիկայում։

Որոշման հրապարակումից հետո 8 շաբաթվա ընթացքում Ադրբեջանը պետք է հաշվետվություն ներկայացնի դատարանին այն քայլերի վերաբերյալ, որոնցով կապահովի ժամանակավոր միջոցների կատարումը։

ՀՀ Միջազգային իրավական հարցերով ներկայացուցիչը 2023թ. սեպտեմբերի 28-ին դիմում էր ներկայացրել ՄԱԿ-ի Արդարադատության միջազգային դատարան՝ Ռասայական խտրականության բոլոր ձևերի վերացման միջազգային կոնվենցիայի շրջանակներում քննվող «Հայաստանն ընդդեմ Ադրբեջանի» գործով ժամանակավոր միջոց կիրառելու մասին խնդրանքով։
