Հակակոռուպցիոն կոմիտեն արձագանքել է ՀՀ դատական դեպարտամենտի հայտարարությանը

Նախօրեին ՀՀ դատական դեպարտամենտը հայտարարություն է տարածել՝ մեջբերելով, մասնավորապես, ՀՀ հակակոռուպցիոն կոմիտեի նախագահ Սասուն Խաչատրյանի՝ կոնկրետ քրեական գործի առնչությամբ նույն օրը ՀՀ կառավարության նիստի ընթացքում կատարած այն դիտարկումը, որ դատարանը, քրեական գործը վարույթ ընդունելուց հետո բոլոր մեղադրյալներին կալանքից ազատել է. «Ես ամենևին չեմ ուզում քննարկել դատարանի որոշումը, բայց մենք ունենք իրավիճակ, երբ, որպես պրակտիկա, կալանքի տակ չգտնվելու դեպքում դատական նիստերը տարիներով ձգձգվում են, դա խնդիր է»:
«Դատական դեպարտամենտը, փաստերի վերը նշված արձանագրումները դիտարկելով որպես դատական իշխանությանն ուղղված մեղադրանք, հայտարարություն է տարածել կոնկրետ քրեական գործով մեղադրյալների նկատմամբ խափանման միջոց կիրառելու հիմնավորումների և նախաքննական մարմնի կողմից ներկայացված ապացույցների բավարարության վերաբերյալ:
Ըստ էության, Դատական դեպարտամենտը, որպես Բարձրագույն դատական խորհրդի աշխատակազմ, կոչված լինելով ապահովել ԲԴԽ-ի, դատարանների, դատավորների ընդհանուր ժողովի և նրա հանձնաժողովների գործունեությունը, ինչպես նաև քաղաքացիական, գանձապետական համակարգի, գնումների, ֆինանսատնտեսական և այլ գույքային իրավահարաբերություններին նշված մարմինների մասնակցությունը, փորձել է մեկնաբանություններ կատարել դատական ակտերի և նախաքննական մարմնի ներկայացարած ապացույցների հիմնավորվածության կապակցությամբ, որի լիազորությամբ օժտված չէ:
Զերծ մնալով դատական քննության փուլում գտնվող քրեական գործերով դատարանների կայացրած որոշումների հրապարակային քննարկումներից և ապացույցների գնահատումից՝ Հակակոռուպցիոն կոմիտեն ձեռնպահ կմնա նաև այդ մասին Դատական դեպարտամենտի տարածած հայտարարության մեջ հնչեցրած մեկնաբանություններին արձագանքելուց՝ հատկապես հաշվի առնելով, որ հիշյալ հայտարարությունը տարածած մարմինը նույնպես նման որևէ իրավասություն չունի»,- ասված է Հակակոռուպցիոն կոմիտեի տարածած հաղորդագրության մեջ:
