Գյուղատնտեսության ոլորտում պետական աջակցության ծրագրերից օգտվող տնտեսավարողների համար ավելի նպաստավոր հարկային միջավայր կձեւավորվի

Հայաստանի Հանրապետության հարկային օրենսգրքում փոփոխություն եւ լրացում նախատեսող օրինագծի նպատակը գյուղատնտեսության ոլորտում պետական աջակցության ծրագրերից օգտվող տնտեսավարող սուբյեկտների համար ավելի նպաստավոր հարկային միջավայրի ձեւավորումն է: Այս մասին ասել է ՀՀ ֆինանսների նախարարի տեղակալ Արման Պողոսյանը դեկտեմբերի 12-ի ԱԺ արտահերթ նիստում:

«Գործող Հարկային օրենսգրքի համաձայն` երբ դրամական միջոցների տեսքով անհատույց գումարներ են ստացվում եւ ստացողն էլ համարվում է շահութահարկ վճարող կազմակերպություն կամ անհատ ձեռնարկատեր, պարտավոր է այդ գումարը ստացման տարվա ընթացքում ամբողջովին եկամուտ ճանաչել շահութահարկով հարկման նպատակով: Իսկ եթե եկամտի կողքը չկան համարժեք ծախսեր, ստացվում է` եկամուտն այդ չափով վեր է ածվում շահույթի, որն արդեն ենթակա է 18 տոկոս դրույքաչափով հարկման»,- ընդգծել է զեկուցողը` հավելելով` պետական աջակցության այդ գումարները ստացողները գործող օրենսդրության պայմաններում եւ այլ հավասար պայմաններում նաեւ հարկային հետեւանքների կրողներ են:

«Եթե, օրինակ, ինտենսիվ այգեհիմնման ծրագիր է իրականացրել որեւէ տնտեսավարող սուբյեկտ, ժամանակի ընթացքում որոշ գումարներ է ծախսել, այնուհետ հայտ է ներկայացրել` պետությունից որոշակի համաֆինանսավորման գումար ստանալու, ապա ստացման տարվա ընթացքում այդ գումարը ենթակա է շահութահարկով հարկման: Սա նշանակում է` այդ մասով պետական աջակցությունը վերջնական նպատակին ամբողջությամբ չի ծառայում»,- նշել է Արման Պողոսյանը եւ պարզաբանել` ի տարբերություն վերոնշյալի, եթե գումարները նախապես, բայց նպատակով տրվեին, եւ տնտեսավարողը սկսեր օգտագործել այդ գումարները կրկին այգեհիմնման ծրագիր իրականացնելու նպատակով, գործող կանոնների համաձայն` ստացված գումարը եկամուտ կհամարվեր ոչ թե անմիջապես ստացման տարվա ընթացքում, այլ ակտիվների ծախսագրմանը կամ կորուստ ճանաչմանը զուգահեռ` չունենալով որեւէ հարկային հետեւանք:

Ըստ փոխնախարարի` կարգապահության տեսակետից այլ հավասար պայմաններում նախընտրելի է, որ տնտեսավարող սուբյեկտն այգեհիմնման օրինակով կատարի ծախսերը, փաստաթղթավորի, այնուհետ հայտ ներկայացնի եւ պետությունից ստանա համաֆինանսավորման գումարը:

«Նախագծով առաջարկում ենք վերջում ստացվող գումարները կրկին չհարկել շահութահարկով, որպեսզի պետական աջակցության գործիքակազմի շրջանակում տրամադրված գումարները մինչեւ վերջին դրամը ծախսվեն հասցեավորված եւ նպատակին»,- մանրամասնելով նախագծի կարգավորման առարկան` ասել է զեկուցողը:

Պատասխանելով պատգամավորների հարցերին` Արման Պողոսյանը վերահաստատել է, որ գործունեության ոլորտի առանձնահատկություններով պայմանավորված` նախաձեռնությամբ առաջարկվող կարգավորումը նախատեսված է միայն գյուղատնտեսության ոլորտում իրականացվող պետական օժանդակության ծրագրերի համար:
