Առաջարկվում է Քննչական կոմիտեի հաստիքների առավելագույն քանակը ավելացնել 47-ով. նախագիծ․ «Փաստ»

«Փաստ» օրաթերթը գրում է.
Արդարադատության նախարարությունը հանրային քննարկման է ներկայացրել Քննչական կոմիտեի մշակած նախագիծը: Մասնավորաբար, առաջարկվում է փոփոխություններ կատարել վարչապետի 2018 թ. հունիսի 11-ի՝ «Պետական իշխանության մարմիններում հաստիքների առավելագույն թիվը սահմանելու մասին» N 706-Ա որոշման մեջ: Որոշման թիվ 6 հավելվածի 8-րդ կետով սահմանված է Քննչական կոմիտեի հաստիքների առավելագույն քանակը, այն է՝ 1332:
2022 թ.-ի հունիսի 9-ի «Ազգային անվտանգության մարմինների մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» թիվ ՀՕ-156-Ն օրենքի կարգավորումների համաձայն՝ Ազգային անվտանգության ծառայության քննչական մարմինը 2024 թ.-ի հունվարի 1-ից դադարեցնելու է իր գործունեությունը տվյալ մարմնի կազմում և ամբողջ հաստիքներով, գործիքակազմով և գործառույթներով փոխանցվելու է Քննչական կոմիտեի համակարգ:
Օրենքի 8-րդ հոդվածի համաձայն՝ 2024 թ.-ի հունվարի 1-ից առնվազն մեկ ամիս առաջ Ազգային անվտանգության ծառայության ինքնավար պաշտոններ զբաղեցնելու առաջարկություն է ներկայացվում և համաձայնություն տված բոլոր անձինք ներառվում են Քննչական կոմիտեի ինքնավար պաշտոնների թեկնածուների ցուցակում: 2024 թ.-ի հունվարի 1-ից հետո՝ տասնօրյա ժամկետում, Քննչական կոմիտեի նախագահը անհրաժեշտ փոփոխություններ է կատարում կոմիտեի կառուցվածքում, պաշտոնների, այդ թվում՝ քաղաքացիական ծառայողների, հայեցողական պաշտոնների, տեխնիկական սպասարկում իրականացնող անձանց անվանացանկի և հաստիքացուցակում, որից հետո ՔԿ-ի ինքնավար պաշտոնների թեկնածուների ցուցակում ընդգրկված անձինք (ՀՀ ազգային անվտանգության ծառայության նախկին քննիչները) տասն աշխատանքային օրվա ընթացքում նշանակվում են համապատասխան պաշտոնի: Այս նախագծով նախատեսվում է Քննչական կոմիտեի հաստիքների առավելագույն քանակը ավելացնել 47ով՝ 1332-ի փոխարեն սահմանելով 1379 հաստիք:
Նախագծի հիմնավորման մեջ ասվում է, որ նշված փոփոխությունների արդյունքում Ազգային անվտանգության ծառայության քննչական մարմնի հաստիքների կրճատման շնորհիվ կավելացվի Քննչական կոմիտեում հիմնական մասնագիտական կառուցվածքային (նախաքննություն իրականացնող) և աջակցող մասնագիտական կառուցվածքային ստորաբաժանումների հաստիքների քանակը, որի շնորհիվ հնարավոր կլինի ապահովել քրեական վարույթների շրջանակներում նախաքննության պատշաճ իրականացումը՝ Քննչական կոմիտեի գործառույթների ավելացման պայմաններում: Ակնկալում են, որ հաստիքների ավելացման շնորհիվ Քննչական կոմիտեում նախաքննության պատշաճ և արդյունավետ իրականացում տեղի կունենա:
Նախագծի ընդունման դեպքում կառաջանա լրացուցիչ ֆինանսական միջոցների հատկացման անհրաժեշտություն, իսկ ՔԿ նախագահը պետք է ընդունի կոմիտեի հիմնական և աջակցող մասնագիտական կառուցվածքային ստորաբաժանումների կառուցվածքում և հաստիքացուցակում փոփոխություններ և լրացումներ նախատեսող հրամաններ:
