Մայրը և տատը իմացել են երեխայի նկատմամբ սեռական ոտնձգության մասին

Երեխաների իրավունքների պաշտպանության գծով միջազգային փորձագետ, իրավաբանական գիտությունների թեկնածու, դոցենտ Դավիթ Թումասյանը ֆեյսբուքյան իր էջում գրել է․
«ՀԵՐԹԱԿԱՆ ԱՅԼԱՆԴԱԿ ՀԱՆՑԱՆՔԸ ԵՐԵԽԱՅԻ ՆԿԱՏՄԱՄԲ
Վարդան Ղուկասյանի տելեգրամյան ալիքը տեսանյութ է տարածել, որում առկա է մանկական պոռնոգրաֆիա: Այդ նյութից ակնհայտ է, որ ոմն Աբո (ըստ տեսանյութում գրառման՝ Արմավիրի մարզից) իր թոռնուհու տարիքի երեխայի նկատմամբ առերևույթ կատարել է առնվազն 2 հանցագործություն՝
1) ՀՀ քրեական օրենսգրքի 300-րդ հոդվածի 2-րդ մաս՝ Մանկական պոռնոգրաֆիա ստեղծելը, տարածելը, մատչելի դարձնելը, տնօրինելը, համակարգչային համակարգում, համակարգչային ցանցում կամ համակարգչային այլ սարքավորումների վրա կամ ցանկացած այլ եղանակով մանկական պոռնոգրաֆիա պահպանելը,
2) ՀՀ քրեական օրենսգրքի 200-րդ հոդված՝ Սեքսուալ բնույթի գործողություններ կատարելը 16 տարին չլրացած անձի նկատմամբ, սակայն այս արարքը կարող է վերաորակվել ՀՀ քրեական օրենսգրքի 198-րդ հոդվածի՝ Սեքսուալ բնույթի բռնի գործողությունները, քանի որ դեռ պետք է պարզվի երեխայի հետ առաջին հարաբերության ներգրավման մեխանիզմը, դատահոգեբանական փորձաքննության արդյունքները և այլ հանգամանքներ:
Այստեղ կարևորվում է այն, որ երեխայի մայրը և տատը գիտեին այդ հանցավոր դրվագների մասին, սակայն ոչինչ չեն ձեռնարկել երեխային պաշտպանելու համար, և միայն 4-րդ, թե 5-րդ դեպքից հետո՝ մայրն Աբոյին վռնդել է տնից….
Մոր և տատու առնչությամբ պետք է քննարկել հետևյալ հանցագործությունների առկայությունը՝ ՀՀ քրեական օրենսգրքի 247-րդ հոդված՝ Երեխայի դաստիարակության կամ խնամքի պարտականությունը չկատարելը կամ ոչ պատշաճ կատարելը (երեխայի առողջության վատթարացումը պետք է դիտարկել նրա հոգեբանական և սեռական առողջությունը), ինչպես նաև ՀՀ քրեական օրենսգրքի 473-րդ հոդված՝ Հանցագործության մասին չհայտնելը կամ ՀՀ քրեական օրենսգրքի 474-րդ հոդված՝ Հանցանք կատարած անձին աջակցելը:
Բացի այդ, քանի որ տեսանյութը տարածվել է տելեգրամյան ալիքով, ապա տարածողի արարքում նույնպես առկա է առերևույթ հանցագործություն՝ նախատեսված ՀՀ քրեական օրենսգրքի 300-րդ հոդվածի 2-րդ մասով՝ Մանկական պոռնոգրաֆիա տարածելը, համակարգչում, համակարգչային համակարգում, համակարգչային ցանցում կամ համակարգչային այլ սարքավորումների վրա կամ ցանկացած այլ եղանակով մանկական պոռնոգրաֆիա պահպանելը:
Հ.Գ. Հուսամ այս երեխայի նկատմամբ հանցանք կատարած բոլոր անձինք կենթարկվեն քրեական պատասխանատվության և հնարավորինս արագ…»։
