Պետական բյուջե է վճարվել շուրջ 621 միլիոն ՀՀ դրամ չվճարված հարկ․ ՔԿ

ՀՀ քննչական կոմիտեի տնտեսական հանցագործությունների և մաքսանենգությունների քննության գլխավոր վարչությունում քննվող քրեական վարույթով բացահայտվել է տնտեսվարող սուբյեկտի կողմից առանց հաշվարկային փաստաթղթերի տրամադրման ապրանքներ իրացնելու և առանձնապես խոշոր չափերով հարկեր չվճարելու հերթական դեպքը։
Այս մասին հայտնում են Քննչական կոմիտեից։
Քրեական վարույթի նախաքննության ընթացքում կատարված մեծածավալ վարութային գործողությունների, ՀՀ պետական եկամուտների կոմիտեի հետաքննության և օպերատիվ հետախուզության վարչության աշխատակիցների կողմից ձեռնարկված համալիր օպերատիվ-հետախուզական միջոցառումների և ՀՀ պետական եկամուտների կոմիտեի հարկային տեղեկատվության և ռիսկերի վերլուծության վարչության աշխատակիցների կողմից իրականացրած ուսումնասիրությունների արդյունքում փաստական տվյալներ են ձեռք բերվել այն մասին, որ Ա․Գ․-ն, 2004թ․ ապրիլի 29-ից հանդիսացել է ավտոմեքենաների յուղերի ու այլ պարագաների ներմուծմամբ և առևտրով զբաղվող ՍՊ ընկերության տնօրենը։ Վերջինս, հարկային օրենսդրության համաձայն, պատասխանատու է եղել ընկերության հաշվապահական հաշվառումը սահմանված ժամկետում հարկային մարմին ներկայացնելը կազմակերպելու, հարկային օրենսդրությամբ նախատեսված հաշվետվություններ, հաշվարկներ, հարկման հիմք հանդիսացող այլ փաստաթղթեր ու տեղեկություններ, հարկերը ճիշտ և ինքնուրույն հաշվարկելու, ժամանակին վճարելու ու հարկային օրենսդրության մյուս պահանջները պահպանելու համար։
ՍՊԸ ընկերության տնօրենը նույն ընկերության գլխավոր հաշվապահ Կ․Բ․-ի հետ նախնական համաձայնությամբ, հարկեր չվճարելու նպատակով, խախտելով «Ավելացված արժեքի հարկի մասին», «Շահութահարկի մասին» ՀՀ օրենքների և ՀՀ հարկային օրենսգրքի պահանջները, 2017թ․ հունվարից 2019թ․ ապրիլը ներառյալ, թաքցրել է ընկերության հարկման օբյեկտը։ Վաճառքներ իրականացնելիս չի տրամադրել հսկիչ դրամարկղային մեքենայի կտրոններ ու դուրս չի գրել հարկային հաշիվներ, իսկ հարկային հաշվարկներում ներառել է խեղաթյուրված տվյալներ, որի արդյունքում պետական բյուջե չի վճարել առանձնապես խոշոր չափերով՝ ընդհանուր շուրջ 705․000․000 ՀՀ դրամ հարկ։
Ձեռք բերված բավարար փաստերի հիման վրա ընկերության տնօրենի և գլխավոր հաշվապահի նկատմամբ ՀՀ քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետով հարուցվել են քրեական հետապնդումներ, և վերջիններիս ներկայացվել է մեղադրանք։
Նախաքննության ընթացքում իրականացված մեծածավալ վարութային և քննչական գործողությունների արդյունքում ձեռք բերված անհերքելի ապացույցների ներքո Ա․Գ․–ն և Կ․Բ․–ն իրենց մեղավոր են ճանաչել և հարկային մարմին են ներկայացրել ճշտված հարկային հաշվարկներ և հայտարարագրել նախկինում թաքցված շուրջ 705․000․000 ՀՀ դրամ հարկային պարտավորությունը, որից պետական բյուջե են վճարել շուրջ 621․000․000 ՀՀ դրամը, իսկ մնացած հարկային պարտավորությունները պարտավորվել են վճարել սեղմ ժամկետում։
Նախաքննությունը շարունակվում է։
Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգովդատարանի` օրինական ուժի մեջ մտած դատավճռով:
