Չցանկանալով նույն խցում պահվել հոր սպանության համար մեղադրվող խցակցի հետ՝ դատապարտյալը սպանել է վերջինիս․ քրեական վարույթն ուղարկվել է դատարան

ՀՀ քննչական կոմիտեի Արմավիրի մարզային քննչական վարչությունում քննվող քրեական վարույթի շրջանակներում իրականացված քննչական և վարութային անհրաժեշտ գործողություններով պարզվել են «Արմավիր» քրեակատարողական հիմնարկի կալանավորի սպանության հանգամանքները:
Մասնավորապես՝ քննությամբ պարզվել և հիմնավորվել է, որ քրեակատարողական հիմնարկի կալանավորն իր հետ նույն պատժախցում գտնվող Ա.Յ.-ին, ում նկատմամբ հանրային քրեական հետապնդում է հարուցվել իր հորը սպանելու համար, պարբերաբար, տևական ժամանակ ենթարկել է բռնության:
Ձեռք բերված փաստական տվյալների համաձայն՝ 2021 թվականի հոկտեմբերի 4-ին, հիշյալ կալանավորն իր հետ նույն խցում պահվող Ա.Յ.-ից պահանջել է կալանքի ժամկետի երկարացման դեպքում իրենց խուց չվերադառնալ՝ սպառնալով, որ հակառակ դեպքում վերջինիս համար վատ կլինի, քանի որ չի ցանկացել նույն խցում պահվել սեփական հորը սպանելու համար մեղադրվող, ինչպես նաև՝ խցում ընդունված վարվելակերպի կանոններին չհետևող անձի հետ։
Սակայն Ա.Յ.-ն հրաժարվել է դատարան գնալ, և վերադարձվել է իր խուց։ Տեսնելով, որ Ա.Յ.-ն չի պատրաստվում տեղափոխվել այլ խուց, վերջինիս պատժելու նպատակով, 2022 թվականի հոկտեմբերին վերոհիշյալ կալանավորը պարբերաբար ձեռքերով ու ոտքերով բազմաթիվ հարվածներ է հասցրել Ա.Յ.-ի մարմնի տարբեր մասերին, կապել նրա ոտքերը, սեղմել պարանոցը, սուր եզր ունեցող, քննությամբ չպարզված առարկայով կամ գործիքով հասցրել կտրվածքներ՝ տուժողին պատճառելով ֆիզիկական ուժեղ ցավ և հոգեկան տառապանքներ, որի ընթացքում վերջինիս մարմնի վրա առաջացել են տարբեր բնույթի և ծանրության տարբեր աստիճանների բազմաթիվ մարմնական վնասվածքներ, որոնց հետևանքով 2022 թվականի հոկտեմբերի 12-ի լույս 13-ի գիշերը՝ ժամը 23:15-ի սահմաններում, Ա.Յ.-ն մահացել է։
Դատաբժշկական փորձաքնության եզրակացության համաձայն՝ տուժողի մահը վրա է հասել տրավմատիկ-հեմոռագիկ, պլևրոպուլոնալ շոկից՝ կրծքավանդակի փակ բութ վնասվածքներ ստանալու հետևանքով, որոնք էլ գտնվում են ուղղակի պատճառական կապի մեջ մահվան հետ:
Ձեռք բերված բավարար փաստերի հիման վրա կալանավորին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 155-րդ հոդվածի 1-ին մասով (սպանություն), 166-րդ հոդվածի 1-ին մասի 1-ին կետով (առողջությանը կյանքի համար վտանգավոր ծանր վնաս պատճառելը) և 196-րդ հոդվածի 1-ին մասով (ֆիզիկական ուժեղ ցավ կամ հոգեկան ուժեղ տառապանք պատճառելը)։
Նախաքննությունն ավարտվել է, և վարույթի նյութերը, մեղադրական եզրակացությամբ, ուղարկվել են դատարան:
