Հրապարակվեց Արմեն Չարչյանի գործով դատավիճռը

Երևանի ընդհանուր իրավասության դատարանի Ավանի նստավայրում այսօր՝ փետրվարի 5-ին, հրապարակվեց Ազգային ժողովի «Հայաստան» խմբակցության նախկին պատգամավոր, «Իզմիրլյան» բժշկական կենտրոնի տնօրեն, պրոֆեսոր Արմեն Չարչյանի գործով դատավճիռը, որը հրապարակեց դատավոր Վահե Միսակյանը։
Չարչյանը մեղադրվում է 2021 թվականի հունիսի 20-ի ընտրություններին մասնակցելուն հարկադրելու համար։ Քվեարկությունից օրեր առաջ (հունիսի 18-ին) տարածվել էր հիվանդանոցի աշխատակիցների հետ Չարչյանի անցկացրած ժողովի ձայնագրությունից մի հատված, որը իրավապահները որակում են որպես ընտրողի ազատ կամքի իրականացմանը խոչընդոտել։ Չարչյանին մեղսագրվող հոդվածում նաև նշվում է որևէ մեկի օգտին դեմ քվեարկելուն հարկադրելու մասին։
Հիշեցնենք՝ դատախազ Հայկ Հովհաննիսյանը պահանջում է մեղավոր ճանաչել Չարչյանին և դատապարտել 5 տարվա ազատազրկման։
Iravaban.net-ի փոխանցմամբ՝ դատարանը վճռեց․
«Արմեն Չարչյանին մեղավոր ճանաչել 18․04․2003թ․ Քրեական օրենսգրքի 184․2 հոդվածի 4-րդ մասի 2-րդ կետով նախատեսված արարքի կատարման մեջ և դատապարտել ազատազրկման 4 տարի ժամկետով։ 18․04․2003թ ընդունված Քրեական դատավարության օրենսգրքի 60-րդ հոդվածի կիրառմամբ նշանակված պատժի կիրառման մեջ հաշվարկել փաստացի անազատության մեջ գտնվելու 4 ամիս, 17 օրը և որպես վերջնական պատիժ նշանակել 3 տարի, 7 ամիս 13 օր ժամկետով ազատազրկմամբ։ 18․04․2003թ ըդնունված Քրեական օրենսգրքի 77-րդ հոդվածի կիրառմամբ Արմեն Չարչյանի նկատմամբ նշանակված ազատազրկման ձևով պատիժը պայմանականորեն չկիրառել՝ սահմանելով փորձաշրջան՝ 3 տարի ժամկետով, վերջինիս նկատմամբ նշանակելով հսկողություն՝ բնակության վայրը և աշխատանքի վայրը փոխելու դեպքում դատապարտյալի վարքագծի նկատմամբ»,-հայտարարեց դատավոր Վահե Միսակյանը։
Դատավճիռը կարող է բողոքարկվել Վերաքննիչ քրեական դատարան՝ 1 ամսվա ընթացքում։
