Ավետիսյանների յոթ հոգանոց ընտանիքի անդամների սպանության մեջ մեղադրվող Վալերի Պերմյակովի գործով այսօր կայացած հերթական դատական նիստը տեղի է ունեցել Գյումրիի ՌԴ 102-րդ ռազմաբազայի տարածքում, այսինքն՝ դահլիճի հետ կապված փոփոխություն չի եղել, նիստը ընթացել է նույն կարգով, ինչ առաջին՝ դեկտեմբերի 18-ին նշանակված նիստի ժամանակ:
Հիշեցնենք, որ ռազմաբազայում դատական նիստի անցկացումը դժգոհության առիթ էր դարձել թե՛ Ավետիսյանների իրավահաջորդների, թե՛ իրավապաշտպանների շրջանում: Անցկացման վայրի վերաբերյալ մեկնաբանություններ փորձեցինք պարզել Դատական դեպարտամենտի ղեկավարի առաջին տեղակալ Աննա Վարդապետյանից:
-Ինչպե՞ս կարձագանքեք դատական նիստի վայրի վերաբերյալ իրավահաջորդների դժգոհություններին, քայլեր ձեռնարկո՞ւմ եք արդյոք նրանց ընդառաջելու ուղղությամբ:
- Հունվարի 18-ի նիստն անց է կացվել ռազմաբազայում, դրա մասին տեղեկատվություն կա համապատասխան կայքում, կա նաև մասնակցության վերաբերյալ բոլոր մանրամասները: Թե դատարանն ինչ կորոշի, դա արդեն քրեական դատավարության օրենսգրքով դատարանի իրավասությունն է:
-Հարցը վերաբերում է ոչ թե նրան, թե ինչ կորոշի դատարանը, այլ թե ինչու է դատավարությունն անցացվում ռազմաբազայում: Արդյոք ձեզ համար ընդունելի՞ է, որ դատավարությունը տեղի է ունենում ՌԴ ռազմաբազայի տարածքում:
-Հիմա որևէ մեկը չի կարող արտագնա նիստ հրավիրելու դատարանի որոշումն իրականացնելու վերաբերյալ մեկնաբանել, կասկածի տակ դնել կամ մեկնաբանել: Դա քրեական դատավարության օրենսգրքով բացառապես դատարանի իրավասությունն է: Եթե ուշադրություն եք դարձրել դատարանի որոշմանը, ապա դատարանը հիմք է ընդունել քրեական դատավարության օրենսգրքի 41-րդ հոդվածը, որի 3-ր մասն ասում է, որ արդարադատության արդյունավետությունից ելնելով՝ տվյալ դեպքում Պերմյակովի մասնակցությունն ապահովելու, նրա արդար դատաքննության իրավունքն ապահովելու, շատ կարևոր դատական պահանջը իրականացնելու նպատակով դատարանը որոշել է, որ պետք է իրականացվի արտագնա դատական նիստ և որևէ մեկը չի կարող սա քննարկել:
-Օրենքը սահմանո՞ւմ է արդյոք դատարանի այդ որոշումը փոխելու հնարավորություն:
-Օրենսգիրքը նախատեսում է, որ երբ դատարանը, եթե արտագնա նիստ անցկացնելու վերաբերյալ որոշում կայացնելու հիմք ծառայած հանգամանքները վերացվեն, կարող է փոխել իր որոշումը, բայց կարող է անել բացառապես գործը քննող դատարանը, այլ ոչ թե որևէ այլ պաշտոնատար անձ:
