Արտագնա աշխատանքի մեկնած ՀՀ քաղաքացիները չեն հարկվել․ պատգամավոր

Ազգային ժողովի պատգամավոր Բաբկեն Թունյանը ֆեյսբուքյան իր էջում անդրադարձել է արտագնա աշխատողներին հարկելու թեմային։
«Հատուկ այն մարդկանց համար, որոնք մի քանի օր է՝ շեփորահարում են, իրենց իսկ խոսքերով, «խոպանչիներին» հարկելու մասին:
Եթե կարճ գրեմ՝ ՀՀ տարածքից դուրս արտագնա աշխատանքի մեկնած ՀՀ քաղաքացիները չեն հարկվել (այլ իրազեկվել են վաղուց գործող օրենքով սահմանված պարտավորության մասին) և չեն հարկվի Հայաստանում:

ՀՀ տարածքից դուրս արտագնա աշխատանքի մեկնած ՀՀ քաղաքացիները օրենքով սահմանված ժամանակահատվածի համար չեն հարկվի Հայաստանում, եթե եկամտի ստացման երկրում վճարել են եկամտային հարկ: Այս մասին հայտնեցին Պետական եկամուտների կոմիտեից՝ «Արմենպրես»-ի խնդրանքով մեկնաբանելով արտագնա աշխատանքի մեկնողների հարկման վերաբերյալ շրջանառվող տարբեր շահարկումները:
ՊԵԿ-ը հայտարարում է, որ մշակվում է օրենսդրական փոփոխությունների նախագիծ՝ ՀՀ ռեզիդենտ ֆիզիկական անձանց կողմից Հայաստանի տարածքից դուրս՝ աշխատանքային կամ աշխատանքների կատարման (ծառայությունների մատուցման) քաղաքացիաիրավական պայմանագրերի շրջանակում ստացված եկամուտների հարկման հետ կապված կարգավորումների մասով։
«Օրենսդրական նոր նախաձեռնության համաձայն՝ ՀՀ տարածքից դուրս արտագնա աշխատանքի մեկնած ՀՀ քաղաքացիները օրենքով սահմանված ժամանակահատվածի համար չեն հարկվելու ՀՀ-ում: Նրանք ազատվելու են եկամտային հարկ վճարելու պարտավորությունից, եթե եկամուտները ստացվել են աշխատանքային կամ քաղաքացիաիրավական պայմանագրի շրջանակում։ Եթե ՊԵԿ-ն այլ պետությունների հարկային մարմիններից օրենքով սահմանված ժամանակահատվածի համար ստանա տեղեկատվություն այն մասին, որ ՀՀ քաղաքացին եկամտի ստացման երկրում վճարել է եկամտային հարկ, ապա լրացուցիչ հարկ վճարելու պարտավորություն Հայաստանի Հանրապետությունում չի առաջանա՝ անկախ այն հանգամանքից, թե եկամտային հարկի ինչ դրույքաչափով է քաղաքացին հարկվել եկամուտի ձեռքբերման երկրում:
Նախագիծը մոտ օրերս հանրային քննարկման կներկայացվի www.e-draft.am կայքում: ՊԵԿ-ը, մինչև համապատասխան օրենսդրական փոփոխությունների իրականացումը, ձեռնպահ կմնա հարկային վարչարարություն իրականացնելուց` ներառյալ արգելադրում, գանձումներ և այլն: Իսկ ովքեր մինչ այս պահը ՊԵԿ-ից ստացել էին ծանուցումներ և պարտաճանաչորեն վճարել էին եկամտային հարկը՝ հետ կստանան վճարված գումարները: Նախագիծը նախատեսվում է լայնորեն քննարկել արտագնա աշխատողների հետ՝ մարզպետարանների և ՏԻՄ մարմինների միջոցով»,-տեղեկացրել են կոմիտեից:
