Քննչական կոմիտեն դատարան է ուղարկել քննիչին կաշառք առաջարկելու դեպքով հարուցված քրեական գործը

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության վարույթում ավարտվել է քննիչին կաշառք առաջարկելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը։ Դեպքն արձանագրվել է թմրամիջոցների ապօրինի շրջանառության դեպքի առթիվ քննվող քրեական գործով. մեղադրյալը գործը քննող քննիչին իր իսկ աշխատասենյակում առաջարկել է կաշառք՝ քրեական պատասխանատվությունից ազատվելու դիմաց, ինչի մասին քննիչն անմիջապես զեկուցագիր է ներկայացրել։

Այսպես՝ ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության ՀԿԳ քննիչի վարույթում թմրամիջոցների ապօրինի շրջանառության դեպքի առթիվ  քննվող քրեական գործով Արարատի մարզի բնակչին  մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 268-րդ հոդվածով (թմրամիջոցների ապօրինի շրջանառությունն առանց իրացնելու նպատակի), իսկ որպես խափանման միջոց՝ ընտրվել չհեռանալու մասին ստորագրությունը: Քրեական գործով քննություն է տարվել՝ թմրամիջոցների ձեռք բերման աղբյուրը պարզելու, բոլոր հանգամանքների բազմակողմանի, օբյեկտիվ և լրիվ հետազոտումն ապահովելու ողղությամբ։

2015թ. նոյեմբերի 24-ին՝ ժամը 17:07-ին, մեղադրյալը զանգահարել է ՀԿԳ քննիչին և, քրեական գործով կարևոր տեղեկություններ հայտնելու պատրվակով, խնդրել ընդունել իրեն: Քննիչը վերջինիս հրավիրել է իր աշխատասենյակ։

Նախաքննությամբ հիմնավորվել է, որ մեղադրյալը քննիչի թույլտվությամբ մուտք է գործել Երևան քաղաքի քննչական վարչության վարչական շենք, բարձրացել քննիչի աշխատասենյակ, որտեղ քննիչին առաջարկել է կաշառք՝ իրեն քրեական պատասխանատվությունից ազատելու դիմաց՝ պատրաստակամություն հայտնելով գումարը տալ նույն պահին։ Քննիչն անմիջապես նրան դուրս է հրավիրել իր աշխատասենյակից և կատարվածի վերաբերյալ ներկայացրել գրավոր զեկուցագիր։

ՀՀ քննչական կոմիտեի դեպարտամենտի տեղեկատվության և հասարակայնության հետ կապերի բաժնից, ՀՀ քննչական կոմիտեի նախագահի հանձնարարությամբ՝ քննիչի զեկուցագրում մատնանշված հանգամանքների ուղղությամբ քննությունն իրականացվել է ՀՀ ՔԿ հատկապես կարևոր գործերի քննության գլխավոր վարչությունում, հարուցվել առանձին քրեական գործ։ Ձեռք բերված ապացույցների համակցությամբ՝ թմրամիջոցների ապօրինի շրջանառության գործով որպես մեղադրյալ ներգրավված Արարատի մարզի բնակչին ՀԿԳ քննության գլխավոր վարչությունում մեղադրանք է առաջադրվել՝ ՀՀ քրեակա ն օրենսգրքի 312-րդ հոդվածի 2-րդ մասով (խոշոր չափերով կաշառք առաջարկելը)։

Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է Կենտրոն եւ Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության դատարան՝ ըստ էության քննելու համար։

Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցվածչէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
