2024 թվականի փետրվարի 27-ին Արցախի մշակութային ժառանգության պահպանության պետական խորհրդի կողմից տարածված հայտարարությամբ պարզ դարձավ, որ Ադրբեջանը ոչնչացրել է Ստեփանակերտի Շառլ Ազնավուրի անվան մշակույթի կենտրոնի տարածքում հայ-ֆրանսիական բարեկամության պուրակում՝ Պոլ Էլյուար Ֆրանկոֆոնիայի Կենտրոնի հարևանությամբ գտնվող Շարլ Ազնավուրի կիսանդրին։

Արձանը կանգնեցվել էր 2022 թվականի մայիսի 22-ին՝ աշխարհահռչակ երգչի ծննդյան 100 ամյակի կապակցությամբ:

Կիսանդրու հեղինակը ճարտարապետ Մամիկոն Ֆարսիյանն է, քանդակագործը՝ Յուրի Հըովհաննիսյանը, ով Շառլ Ազնավուրի ժպտացող քանդակով փորձել է ծանր իրավիճակում գտնվող արցախցիներին գալիքի հույս ներշնչել: Շենքի ճակատին փակցված էր արցախցի քանդակագործ Հրանտ Մնացականյանի «Մեղեդի» պաննոն: Վերջինիս  ներկա վիճակի մասին տեղեկություններ չկան:

Ինչպես փաստում են լուսանկարները, որոնք արվել են մինչ ադրբեջանական վանդալիզմը, հուշարձանը ամբողջական էր, իսկ նույն վայրն արդեն այսօր առանց Շառլ Ազնավուրի հուշարձանի է։

Monument Watch-ը տարածել է հայտարարություն․

«Միջազգային մարդասիրական իրավունքի շրջանակներում մշակութային ժառանգությունը համարվում է մարդու ստեղծագործ մտքի բացառիկ արտահայտություն, որի ոչնչացումը կամ վնասումը ուղղակիորեն խախտում է մարդու/համայնքի անդամների մշակութային իրավունքները թե՜ պատերազմի ժամանակ և թե՜ պատերազմից հետո։

Միջազգային քրեական դատարանի 8-րդ հոդվածը օկուպացված տարածքներում մշակութային ժառանգության ոչնչացումը միջազգային ռազմական հանցագործություն է համարում․ «Արգելվում է դիտավորյալ ուղղորդել հարձակումները կրոնին, կրթությանը, արվեստին, գիտությանը կամ բարեգործական նպատակներին նվիրված կառույցների, պատմական հուշարձանների, հիվանդանոցների, վրա, եթե դրանք ռազմական թիրախներ չեն:

Հարկ է նշել նաև, որ զինված բախումների դեպքում մշակութային արժեքների ոչնչացումն արգելող Հաագայի 1954 թվականի կոնվենցիայի համաձայն հուշարձանի ունեցած վաղեմությունը (հին, թե նոր), կամ բնույթը չեն կարող պատճառ դառնալ արդարացնելու ոչնչացումը։ Համաձայն կոնվենցիայի առաջին հոդվածի, մշակութային արժեքը վերազգային և համամարդկային է. «Մշակութային արժեքը, անկախ ծագումից, յուրաքանչյուր ժողովրդի համար մեծ նշանակություն ունեցող շարժական կամ անշարժ ժառանգությունն է, ինչպիսիք են ճարտարապետության, արվեստի կամ պատմության հուշարձանները՝ անկախ իրենց կրոնական կամ աշխարհիկ բնույթից....»։

Ուստի՝ ժառանգությունը պետք է պահպանվի, որտեղ էլ որ այն գտնվի, երբ էլ որ այն ստեղծված լինի։  Կոնվենցիայի տրամաբանությունից ելնելով՝ ազգերն են որոշելու, թե ինչն է իրենց՝ «մեծ կարևորության» ժառանգությունը, այս դեպքում՝ արցախահայերը։ Եվ անկախ նրանից, թե ինչ տեսք ունի այն կամ ինչ զգացողություններ է առաջացնում Ադրբեջանի մոտ, պետք է պահպանվի։ Եվ եթե 20-րդ դարում մշակութային ժառանգությունն անպայմանորեն պետք է օժտված լիներ անցյալի պատմական նշանակությամբ, ապա 21-րդ դարի ժառանգության տեսա-իրավական համակարգում ժառանգություն են համարվում թե՛ անցյալի, թե՛ ներկայի արժեքները»,-ասված է հայտարարության մեջ։
