Միջնակարգ դպրոցից 28 մլն ՀՀ դրամից ավելի գումար հափշտակելու համար մեղադրվող աշխատակիցը հայտնաբերվել է

Ավարտվել է Գեղարքունիքի մարզի Կարճաղբյուր գյուղի միջնակարգ դպրոցի միջոցներից առանձնապես խոշոր չափի՝ 28 մլն ՀՀ դրամից ավելի գումար հափշտակելու դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննությունը։
ՀՀ քննչական կոմիտեի Գեղարքունիքի մարզային քննչական վարչության Վարդենիսի քննչական բաժնում իրականացված քննությամբ պարզվել է, որ Կարճաղբյուր բնակավայրի «Ա.Գրիգորյանի անվան միջնակարգ դպրոց» ՊՈԱԿ-ի ընթացիկ գործունեությունը ղեկավարելու իրավասութուն ունեցող անձը, 2016-2019 թվականների ընթացքում, ունենալով կազմված աշխատավարձերի բաշխման վերաբերյալ փաստաթղթերի իսկությունը ստուգելու և դրանից հետո միայն հաստատելու պարտականություն, առանց օրենսդրական հիմքերի, աշխատավարձերի վճարման գանձապետական համակարգից օգտվելու կանոնները չիմանալու պատճառաբանությամբ, իր փոխարեն նշված գործողությունների կատարումը վստահել է դպրոցի ֆինանսական գործառնություններ կատարելու իրավասություն ունեցող անձին՝ վերջինիս տրամադրելով իր նույնականացման քարտը, աշխատավարձերի վճարման գանձապետական համակարգ մուտք գործելու համար նախատեսված իր մուտքանուն-գաղտնաբառը։
Արդյունքում վերջինս, ունենալով դպրոցի բյուջեի միջոցները տնօրինելու լիազորություն, ծառայողական լիազորություններն օգտագործելով, դպրոցի՝ իրեն վստահված միջոցներից, առանց օրինական հիմքերի, որպես աշխատավարձի գումարներ, ելքագրել և մաս-մաս ինչպես իր, այնպես էլ դպրոցի աշխատակից չհանդիսացող իր կնոջ, ծանոթի ու քննությամբ ինքնությունները չպարզված այլ անձանց հաշիվներին փոխանցել է ընդհանուր առմամբ 28.526.400 ՀՀ դրամ գումար ու հափշտակել՝ ՊՈԱԿ-ին պատճառելով առանձնապես խոշոր չափերի գույքային վնաս: Նախաքննության ընթացքում նշված վնասից վերականգնվել է 1մլն ՀՀ դրամը։
Ձեռք բերված բավարար փաստերի հիման վրա՝ դպրոցի նախկին՝ գործունեությունը ղեկավարելու իրավասութուն ունեցող անձին մեղադրանք է ներկայացվել ՀՀ նախկին քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով: Վերջինիս մասով նախաքննությունն ավարտվել է 2023թ․ օգոստոսին, և այդ մասով քրեական վարույթի նյութերը, մեղադրական եզրակացությամբ, ուղարկվել էին դատարան:
Դպրոցի բյուջեի միջոցները տնօրինելու լիազորություն ունեցող աշխատակցի նկատմամբ նոր հանրային քրեական հետապնդում է հարուցվել ՀՀ քրեական օրենսգրքի 256-րդ հոդվածի 3-րդ մասի 3-րդ կետով։
Քննությունից խուսափելու հիմքով վերջինիս նկատմամբ քրեական հետապնդման ժամկետը կասեցվել էր, սակայն 2024 թվականի հունվարի 29-ին Ոստիկանության Ինտերպոլ ԱԿԲ-ից տեղեկություն է ստացվել վերջինիս՝ Հայաստան ժամանելու մասին։
Տղամարդը ձերբակալվել է և ներկայացվել վարույթն իրականացնող մարմնին։ Վերսկսված վարույթով նրան ներկայացվել է մեղադրանք, առաջադրված մեղադրանքում վերջինս իրեն մեղավոր է ճանաչել։
Միջնորդություն է ներկայացվել դատարան՝ նրա նկատմամբ կիրառված կալանքը վերստին քննարկելու համար, որը բավարարվել է մասնակի․ դատարանի որոշմամբ որպես խափանման միջոց է ընտրվել տնային կալանքը՝ համակցված 3.500.000 ՀՀ դրամ գրավով:
Նախաքննությունն ավարտվել է նաև նշված անձի մասով, և նրա վերաբերյալ վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են հսկող դատախազին՝ այն հաստատելու և դատարան ուղարկելու նպատակով։
Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով դատարանի` օրինական ուժի մեջ մտած դատավճռով:
