ԵԽ խոշտանգումների դեմ պայքարի կոմիտեն Հայաստանում դրական արձանագրումներ է գրանցել

Եվրոպայի խորհրդի խոշտանգումների դեմ պայքարի կոմիտեն (CPT), ՀՀ Կառավարության պահանջով, մարտի 1-ին հրապարակել է Հայաստան կատարած 6-րդ այցի ավարտին ներկայացված նախնական զեկույցը։
2023 թ. սեպտեմբերի 12-ից 22-ը Հայաստան կատարած այցի շրջանակներում Կոմիտեի պատվիրակությունը հանդիպումներ է ունեցել նաև Ներքին գործերի նախարարի տեղակալի և այլ բարձրաստիճան անձանց հետ։ Պատվիրակությունը եղել է ազատությունից զրկման վայրերում, ներառյալ՝ ՆԳՆ Ոստիկանության ձերբակալվածների պահման վայրերում՝ դիտարկելու ԵԽ խոշտանգումների դեմ պայքարի կոմիտեի սահմանած չափորոշիչներին համապատասխանությունը, ինչպես նաև քննարկելու ՀՀ գրանցած առաջընթացը Կոմիտեի կողմից նախկինում տրված հանձնարարականների կատարման վերաբերյալ: Կոմիտեի անդամները նաև հարցազրույցներ են ունեցել ՁՊՎ-ներում պահվող անձանց հետ՝ Ոստիկանության ծառայողների կողմից նրանց նկատմամբ վերաբերմունքի շուրջ։
Անդրադառնալով զեկույցի բովանդակությանը՝ հարկ է նկատել, որ Կոմիտեն մի շարք ուղղություններով դրական արձանագրումներ է արել:
Պատվիրակության կողմից անցկացված հարցազրույցների մեծ մասի ընթացքում ՁՊՎ-ներում պահվող անձինք նշել են, որ Ոստիկանության աշխատակիցներն իրենց հետ պատշաճ են վերաբերվել։
Անդրադառնալով վատ վերաբերմունքի դեմ պայքարի իրավական երաշխիքներին՝ պատվիրակությունը նշել է, որ իրավիճակը, ընդհանուր առմամբ, բարելավվել է 2019 թ. կատարած պարբերական այցի համեմատ: Միևնույն ժամանակ դրական է գնահատվել 2022 թ. ընդունված Քրեական դատավարության օրենսգրքի կիրառումը։
Կոմիտեն նաև մատնանշել է ֆիզիկական վատ վերաբերմունքի, ձերբակալման ընթացքում անհամաչափ ֆիզիկական ուժի կիրառման և մի քանի այլ մասնավոր դեպքերի առկայությունը։
Կոմիտեն ընդգծել է, որ «ոչ պաշտոնական զրույցների» պրակտիկան մեծամասամբ վերացել է՝ արձանագրելով նաև, որ երբեմն ձերբակալված անձին կարող են դեպքի վերաբերյալ հարցեր տրվել առանց նրա փաստաբանի ներգրավման։
Դրական է գնահատվել այն հանգամանքը, որ ոստիկանության ՁՊՎ բերման ենթարկվելուց հետո ձերբակալված անձինք բժշկի կողմից զննության են ենթարկվում, և արձանագրվում են հնարավոր բոլոր վնասվածքները։
Կոմիտեն նաև դրական է գնահատել այն հանգամանքը, որ գործերի քննության ընթացքում բոլոր հարցազրույցները տեսաձայնագրվում են, իսկ պարեկային ծառայողները իրենց ծառայության ընթացքում կրում և մշտապես կիրառում են տեսաձայնագրող սարքեր։
Այդ համատեքստում Կոմիտեն կարևորել է իրավիճակի բարելավման գործողությունները՝ ոստիկանության օպերատիվ ծառայողների կողմից դյուրակիր տեսաձայնագրող սարքերի կիրառումը և ընդգծել ոստիկանության ստորաբաժանումներում նախնական հարցաքննությունների ընթացքում տեսանկարահանման կարևորությունը։
ՁՊՎ-ների շենքային պայմանների վերաբերյալ արձանագրվել է, որ ներկա փուլում ընդհանուր առմամբ բավարարում են սահմանված չափորոշիչներին։
Եվրոպայի խորհրդի խոշտանգումների դեմ պայքարի կոմիտեի զեկույցն ամբողջությամբ կընդունվի և կներկայացվի Հայաստանի Կառավարությանը մարտի վերջին, և ՆԳ նախարարությունը կներդնի իր բոլոր ջանքերը՝ Կոմիտեի կողմից ներկայացվող խնդիրները հրատապ հասցեագրելու ուղղությամբ։
