«Փաստ» օրաթերթը գրում է.

Աշխատանքի և սոցիալական հարցերի նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2022 թ. օգոստոսի 11-ի N 1264-Ն որոշման մեջ: Այս կերպ ակնկալվում է հստակեցնել անձնական օգնականի ծառայության հետ կապված իրավահարաբերությունները և բարելավել օրենսդրական դաշտը։ «Անձնական օգնականի ծառայություն տրամադրելու կարգը և պայմանները հաստատելու մասին» N 1264-Ն որոշումը գործում է 2024 թ. հունվարի 1-ից: Անձնական օգնականի ծառայությունների մատուցման շրջանակներում կնքվում է երկկողմ պայմանագիր՝ շահառուի և անձնական օգնականի միջև, սակայն նշված ծառայության համար վճարումը կատարվում է պետբյուջեից՝ Միասնական սոցիալական ծառայությանը (ՄՍԾ) հատկացված միջոցների հաշվին:

Տվյալ իրավակարգավորումը գործնականում խնդիր է առաջացնում, քանի որ ծառայությունը պետբյուջեի միջոցների հաշվին վճարում է կատարելու մի պայմանագրի շրջանակներում, որի կողմը չի հանդիսանում։ Բացի դա, ֆիզիկական անձ հանդիսացող շահառուն և անձնական օգնականը հարկային վճարումների տեսանկյունից ինքնուրույն սուբյեկտ չեն հանդիսանում, և տվյալ դեպքում առկա է հարկային գործակալի անհրաժեշտություն, ուստի խնդիր է առաջանալու նաև անձնական օգնականի ծառայությունների պայմանագրի հիման վրա հարկերի վճարման տեսանկյունից։ Այսպիսով՝ նախագծով նախատեսվում է պայմանագրի կնքման դրույթ անձնական օգնականի և Միասնական սոցիալական ծառայության միջև, սահմանվում է այդ պայմանագրի օրինակելի ձևը։

Սահմանված ամսական առավելագույն ժամաքանակի ընթացքում հաշմանդամություն ունեցող անձին ծառայություն է մատուցում մեկ՝ նույն անձնական օգնականը։ Եթե մշտադիտարկման արդյունքում պարզվում է, որ հաշմանդամություն ունեցող անձը չի ապահովել սովորելու կամ աշխատելու պահանջը, ապա մշտադիտարկում իրականացնող անձը (անձինք) այդ մասին գրավոր տեղեկացնում է ՄՍԾ-ին, վերջինս կազմակերպում է անձնական օգնականի և ՄՍԾ-ի միջև կնքված պայմանագրի լուծումը։ Հաշմանդամություն ունեցող անձի հետ պայմանագիր հաջորդիվ կնքվում է, եթե նա աշխատում կամ սովորում է։ 2024 թ. բյուջեի հայտով անձնական օգնականի ծառայության ներդրման համար նախատեսվել է 151,048.8 հազար դրամ՝ հաշմանդամություն ունեցող 100 անձի անձնական օգնականի ծառայություն մատուցելու նպատակով։
