«Փաստ» օրաթերթը գրում է.
Սահմանադրական դատարանը որոշել է վերսկսել Վճռաբեկ դատարանի նախկին դատավոր Սուրեն Անտոնյանի դիմումի քննությունը` գրավոր ընթացակարգից անցնելով բանավորի: Ըստ Սահմանադրական դատարանի կայքում տեղակայված ՍԴԱՈ-59 որոշման, բանավոր քննությունը պայմանավորված է գործի հանգամանքներն առավել արդյունավետ բացահայտելու նպատակով։ Գործի դատաքննությունը նշանակվել է 2024 թվականի ապրիլի 26-ին՝ ժամը 11:00-ին: Դիմումով վիճարկվում է արդարադատության նախկին նախարար Կարեն Անդրեասյանի նախաձեռնությամբ ՀՀ դատական օրենսգրքում ՄԻԵԴ վճիռների առիթով դատավորների նկատմամբ կարգապահական վարույթ հարուցելու իրավակարգավորմանը հետադարձ ուժ տալու վերաբերյալ կատարված փոփոխության արդյունքում դատավորի նկատմամբ կարգապահական վարույթ հարուցելու առիթ նախատեսող նորմին հետադարձ ուժ տալու և կիրառելու սահմանադրականությունը:
Արդարադատության նախորդ նախարար Ռուստամ Բադասյանը նախաձեռնել էր ՀՀ դատական օրենսգրքում իրավական հանրույթի կողմից քննադատության արժանացած՝ օրենքին հետադարձ ուժ տալու վերաբերյալ փոփոխությունը, սակայն քննադատությունը մեղմվել էր օրենքի ընդունումից հետո կիրառման և հետագա բարեփոխումների խոստումներով: ՀՀ քաղաքական իշխանությունն, ավանդույթի համաձայն, փաստացի խաբեց միջազգային գործընկերներին, և արդարադատության հաջորդ նախարարը «փայլուն» իրականացրեց անհրաժեշտ օպերացիան՝ հարվածի տակ դնելով երկրի վարկանիշն ու հեղինակությունը: Պետք է նկատել, որ օրենսդրական փոփոխությունները քաղաքական իշխանության աջակցությամբ սահուն կերպով անցկացնելուց հետո արդարադատության նախարարն իր տեղակալի հետ տեղափոխվեց Բարձրագույն դատական խորհուրդ՝ որպես նախարար թողնելով բիզնես գործընկերոջը:
Զբաղեցնելով ԲԴԽ նախագահի պաշտոնը՝ արդարադատության նախկին նախարարը կարողացել է չեզոքացնել իր խմբագրած օրենսդրական փոփոխության սահմանադրականության հարցի քննարկումները՝ մերժելով կարգապահական վարույթների քննության ընթացքում Սահմանադրական դատարան դիմելու միջնորդությունները: Միջազգային իրավական կառույցների կողմից քննադատված բադասյանաանդրեասյանական «աճպարարության» արդյունքում դադարեցվել են մի քանի դատավորների լիազորություններ, և այդ կապակցությամբ Մարդու իրավունքների եվրոպական դատարան ներկայացված դիմումները վարույթ են ընդունված առաջնահերթ և հրատապ կարգով քննելու նպատակով: Այժմ խոսքը Սահմանադրական դատարանինն է...
