Ապրիլի 19-ին «Ֆեյսբուք» սոցիալական ցանցում փաստաբանի կողմից հրապարակվել է մեկ անձի ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Շենգավիթ վարչական շրջանի քննչական բաժնի վարչական շենքից պատգարակով շտապօգնության մեքենային մոտեցնելու տեսարաններով տեսանյութ՝ կից գրառմամբ այն մասին, թե տվյալ անձը քննչական նշված ստորաբաժանումում ենթարկվել է խոշտանգման, ինչը չի համապատասխանում իրականությանը։ Գրառման մեջ տրված որակումը իրականության խեղաթյուրման և իրավապահ մարմինների աշխատանքն անվանարկելու անթույլատրելի փորձ է։ Այս մասին հայտարարել է Քննչական կոմիտեն։
«Հաշվի առնելով հանրությանը նման մանիպուլյացիոն հնարքով, փաստերի խեղաթյուրմամբ մոլորեցնելուց զերծ պահելու անհրաժեշտությունը՝ հայտնում ենք, որ իրականում տեղի է ունեցել հետևյալը։
2024թ․ ապրիլի 3-ին դիմակավորված և զինված անձի կողմից Բագրատունյաց փողոցում գտնվող «Հայփոստ»-ի բաժանմունքում ավազակության փորձ կատարելու դեպքի առթիվ նախաձեռնված քրեական վարույթի շրջանակներում, որպես վկա համապատասխան քննչական գործողություններին մասնակցելու նպատակով, ՀՀ քննչական կոմիտեի ԵՔՔՎ Շենգավիթ վարչական շրջանի քննչական բաժին է հրավիրվել Գ․Մ-ն, ով ներկայացել է փաստաբանի հետ։
Հանցագործությունը կատարած անձի կողմից դեպքի վայրում թողնված առարկայի վրա ԴՆԹ հետքի պատկանելիությունը պարզելու նպատակով վարույթն իրականացնող քննիչի կողմից որոշում է կայացվել դատագենետիկական փորձաքննություն կատարելու համար Գ․ Մ․-ից նմուշ ստանալու մասին, սակայն վերջինս հրաժարվել է նմուշներ տալուց, որպիսի պայմաններում վարույթն իրականացնող մարմնի կողմից որոշում է կայացվել Գ․Մ․-ի հագին եղած հագուստն առգրավելու մասին, և քննչական գործողության կատարման բնականոն ընթացքն ապահովելու նպատակով, ՀՀ քրեական դատավարության օրենսգրքի 210-րդ հոդվածով սահմանված կարգով, դրա կատարմանը ներգրավվել են հետաքննության աշխատակիցները:
Հիշյալ քննչական գործողության կատարման ընթացքում Գ․ Մ․-ն, քննությանը խոչընդոտելու նպատակով, ձեռքերով ու ոտքերով անկանոն շարժումներ է կատարել և այդ կերպ անհնարին դարձրել քննչական գործողության կատարումը, որից հետո գլխի ճակատային մասով 3 անգամ հարվածել է աշխատասեղանին, ապա՝ պատճառաբանելով, թե իրեն լավ չի զգում, խնդրել է բժիշկ կանչել, ինչն էլ կատարվել է: Ժամանած շտապբուժօգնության աշխատակիցները Գ.Մ.-ին տեղափոխել են բժշկական հաստատություն:
Հաշվի առնելով, որ Գ․Մ․-ի վերոնշյալ գործողություններում առերևույթ առկա են վարույթի քննությունը խոչընդոտելու հատկանիշներ՝ ՀՀ քրեական օրենսգրքի 486-րդ հոդվածի 1-ին մասով (արդարադատության իրականացմանը կամ գործի քննությանը միջամտելը) նախաձեռնել է քրեական վարույթ: Գ․Մ․-ն, հանցավոր արարք կատարելու հիմնավոր կասկածի հիմքով, ձերբակալվել է և ներկայացվել վարույթն իրականացնող մարմնին։
Պնդումներն այն մասին, որ Գ․Մ․-ն ենթարկվել է խոշտանգման, որևէ փաստական հիմքեր չունեն։ Մնացած հանգամանքները կպարզվեն նախաքննությամբ»,– ասված է հաղորդագրության մեջ։
