«Կովկասի ժառանգության մշտադիտարկում» նախաձեռնության (Caucasus Heritage Watch) արբանյակային մոնիթորինգի արդյունքում պարզ է դարձել, որ ապրիլի 4-ին ամբողջությամբ ավերվել է Շուշիի Ղազանչեցոց կամ Հին գերեզմանոցը (https://caucasusheritage.cornell.edu/?p=1593, նկ․ 1)։ Գերեզմանատան ավերումն սկսվել էր դեռևս 2023 թվականի հոկտեմբերին, երբ արձանագրվել էր 18-19-րդ դարերի բազմաթիվ տապանաքարերի ոչնչացումը (մանրամասն՝ Ադրբեջանը ոչնչացնում է Շուշիի գերեզմանոցները), գրում է monumentwatch.org-ը:

Մեր արձագանքը

Պատմական գերեզմանատների ոչնչացումը բռնազավթված տարածքներում Ադրբեջանի քաղաքականության հստակ ուղղությունն է, քանի որ հիշյալ քաղաքականության արդյուքնում արդեն իսկ ոչնչացվել են Մեծ Թաղերի, Սղնախի, Շուշիի Հյուսիսային և Երևանի դարպասների գերեզմանոցները, ինչպես նաև Վազգենաշեն գյուղի մերձակայքում գտնվող գերեզմանատունը։

Համաձայն «Զինված հակամարտությունների ժամանակ մշակութային արժեքների պաշտպանության մասին» 1954 թվականի Հաագայի կոնվենցիայի 4-րդ հոդվածի՝ արգելված է մշակութային ժառանգության հանդեպ վանդալիզմի, գողության, կողոպուտի, յուրացման, թշնամանքի և հաշվեհարդարի ցանկացած գործողություն։ Ըստ Հաագայի 1954 թվականի առաջին արձանագրության՝ արգելված է գրավյալ տարածքներում ոչնչացնել մշակութային կամ հոգևոր արժեքները։

Մշակութային ժառանգության նմանօրինակ դիտավորյալ ոչնչացման քաղաքականությունը դատապարտվում է նաև «Մշակութային ժառանգությունը դիտավորյալ ոչնչացնելու մասին» ՅՈՒՆԵՍԿՕ-ի 2003 թվականի հռչակագրով։

Կարևոր է նշել, որ գերեզմանոցի ոչնչացումը անձնական արժանապատվության դեմ իրականացված հանցագործության կարող է համարվել, Հռոմի Ստատուտի մեկնաբանությամբ տուժած «անձանց» թվում դիտարկելով նաև մահացած անձանց։ Այս իմաստով, հարկ է նշել, որ գերեզմանոցների ավերմամբ պղծվում են դիակները՝ խախտելով մահացած անձի մշակութային հուղարկավորության գործելակերպը, կարող է անձնական արժանապատվության վիրավորանք համարվել: Գերեզմանոցների ոչնչացումը, ոչնչացումը խախտում է արցախահայերի մշակույթի իրավունքը՝ թույլ չտալով պահպանել հիշողությունը։ Հիշեցնենք, որ մշակույթի իրավունքը հիմնարար է՝ ամրագրված Մարդու իրավունքների համընդհանուր հռչակագրի 27-րդ հոդվածը և ՄԱԿ-ի 1966 թվականի «Տնտեսական, քաղաքական և մշակութային իրավունքների դաշնագրի» 15-րդ հոդվածը։ Ժառանգության մուտքի բացակայությունը և դրա հետևանքով մարդկանց թաղման ավանդական ծեսերը կատարելու անկարողությունը կարող է համայնքներին զրկել իրենց ծեսերը կենդանի պահպանելու հնարավորությունից (See UN General Assembly, Resolution 72/258 (26 January 2021) (promoting a culture of peace and tolerance to safeguard religious sites)., ուստիև խախտել նաև դեռ չծնված երեխաների՝ իրենց կենսընթացին համապատասխան ապրելու իրավունքը։
