Նիկոլ Փաշինյանին քրեական պատասխանատվության ենթարկելու պահանջով հաղորդում ներկայացվեց ՀՀ գլխավոր դատախազություն

ՀՀ քրեական օրենսգրքի 418-րդ և 421-րդ հոդվածներով հանցագործության մասին հաղորդում ներկայացվեց ՀՀ գլխավոր դատախազություն` Նիկոլ Փաշինյանին քրեական պատասխանատվության ենթարկելու պահանջով՝ Տավուշում ՀՀ ինքնիշխան տարածքները և բնակավայրերը Ադրբեջանին հանձնելու գործընթաց սկսելու կապակցությամբ։
Հաղորդումը կազմել են փաստաբան Արա Զոհրաբյանը և պահեստազորի գնդապետ Հայկ Նահապետյանը։
ՀՀ քրեական օրենսգրքի 418-րդ հոդվածի համաձայն․
1. Պետական դավաճանությունը՝ թշնամու կողմն անցնելը, լրտեսությունը, օտարերկրյա պետությանը, օտարերկրյա կամ միջազգային կազմակերպությանը կամ դրա ներկայացուցչին պետական գաղտնիք պարունակող տեղեկություն հանձնելը կամ այդ տեղեկությանը նշված անձանց ծանոթանալու համար պայման ստեղծելը կամ թշնամական գործունեություն իրականացնելու համար այլ օգնություն ցույց տալը, որը կատարել է Հայաստանի Հանրապետության քաղաքացին՝ ի վնաս Հայաստանի Հանրապետության ինքնիշխանության, տարածքային անձեռնմխելիության կամ արտաքին անվտանգության՝ պատժվում է ազատազրկմամբ՝ տասնհինգից քսան տարի ժամկետով, կամ ցմահ ազատազրկմամբ:
ՀՀ քրեական օրենսգրքի 421-րդ հոդվածի 1-ին մասի համաձայն․
1. Տարածքային ամբողջականությունը խախտելուն` բռնություն գործադրելու կամ բռնություն գործադրելու սպառնալիքի միջոցով Հայաստանի Հանրապետության տարածքի մասն առանձնացնելուն կամ Հայաստանի Հանրապետության տարածքը կամ դրա մասն այլ պետությանը հանձնելուն ուղղված գործողություններ կատարելը`
պատժվում է ազատազրկմամբ` տասից տասնհինգ տարի ժամկետով:
Հաղորդմամբ պահանջվում է՝ «հանձնարարել նախաձեռնել քրեական վարույթ, ձեռնամուխ լինել նախաքննության իրականացմանը և լուծել Նիկոլ Փաշինյանին քրեական պատասխանատվության ենթարկելու հարցը»:
