Հայոց Ազգային Արժանապատվության տրիբունալի ստեղծումն անհրաժեշտություն է. Արշակ Կարապետյան
POLITICS«Համահայկական ճակատ» շարժման առաջարկը՝ Հայոց Ազգային Արժանապատվության տրիբունալ ստեղծելու վերաբերյալ, ուշագրավ քննարկումների առիթ է դարձել ոչ միայն այդ տրիբունալի հեռանկարից վախեցող գործող իշխանությունների, այլ նաև հանրային լայն շրջանակների մեջ, որոնք ցանկանում են հասկանալ, թե իրենից ի՞նչ է ներկայացնելու տրիբունալը, ինչպե՞ս է աշխատելու և ինչպե՞ս է կայացնելու իր առանցքային վճիռները։
Ի՞նչ է տրիբունալը։ Բառը ծագում է լատինական «տրիբունալ»՝ դատարան, դատելու վայր բառից։ Հին Հռոմում տրիբունալ կոչում էին քարից, հողից, կամ փայտից պատրաստված քառանկյուն բարձունքները, որոնց վրա նստում էին դատավորներն ու վճիռներ էին կայացնում։ Հետագայում, միջին դարերում տրիբունալն օգտագործում էր եկեղեցին՝ անհավատներին դատելու նպատակով։ Արդեն 19-20-րդ դարերում տրիբունալները մի քանի տեսակ էին, որոնք քննում էին ռազմական և առանձնահատուկ ծանր քաղաքացիական հանցագործությունները։
Արտակարգ դատարանների այս ֆունկցիան 20-րդ դարում ընդամենը մեկն է. կազմավորվելուց հետո քննարկել կոնկրետ որևէ գործ, վճիռ կայացնել և դադարեցնել իր գործունեությունը։
«Համահայկական ճակատ» շարժման առաջնորդ, Պաշտպանության նախկին նախարար, գեներալ-մայոր Արշակ Կարապետյանը, հիշեցնենք, առաջարկում է «Հայոց Ազգային Արժանապատվության տրիբունալ» ստեղծել, որի միջոցով էլ հանրային դատապարտման ենթարկել Նիկոլ Փաշինյանին և Հայաստանը ծայրահեղ ծանր վիճակի հասցրած նրա թիմակիցներին, քանի որ Հայաստանում գործող դատական համակարգն ունակ չէ գնահատական տալ երկրի ղեկավարի գործունեությանը։
Սովորաբար տրիբունալների օրինակ կարելի է համարել Նյուրնբերգի դատավարությունը, որը 2-րդ համաշխարհային պատերազմից հետո ձևավորվել էր մի քանի երկրների կողմից և խիստ պատիժներ կայացրել նացիստական Գերմանիայի ռազմական հանցագործների նկատմամբ։ Դատաքննության ավարտից հետո Նյուրնբերգի ռազմական տրիբունալը դադարեցրել էր իր գործունեությունը՝ այդ կերպ մտնելով պատմության մեջ։
Կոնկրետ Հայաստանի մասով՝ Հայոց Ազգային Արժանապատվության տրիբունալ ստեղծելու առաջարկը չափազանց ուշագրավ և անհրաժեշտ է։ Կարապետյանն, ընդ որում, առաջարկում է այդ տրիբունալում ընդգրկել հանրային լայն ճանաչում ունեցող իրավաբանների, պատմաբանների, վստահություն վայելող մարդկանց, որոնք, քննելով Նիկոլ Փաշինյանի և նրա հանցախմբի գործունեությունը, կկայացնեն այնպիսի մի վճիռ, որը կբխի հայ ժողովրդի ընդհանուր շահերից: Լայն առումով՝ դա դատարան անվանել հնարավոր չէ՝ բառի ավանդական ընկալմամբ, բայց փաստ է, որ այսօր Հայաստանին նման մի կառույց է անհրաժեշտ, քանի որ փաշինյանական իշխանությունն այնպիսի արհավիրքներ է բերել Հայաստանի Հանրապետությանը, որ սովորական քաղաքացիական դատարաններով քննությունը տևելու է երկար տարիներ, իսկ տրիբունալի գործունեությունը կարող է լինել ավելի կարճ և որևէ կասկածի տեղիք չտալ հանրության շրջանում։
