Արշակ Կարապետյանի առաջարկը Հայոց ազգային արժանապատվության տրիբունալ ստեղծելու վերաբերյալ մասնագիտական քննարկումների լայն դաշտ է բացել

«Համահայկական ճակատ» շարժման առաջնորդ, պաշտպանության նախկին նախարար գեներալ-մայոր Արշակ Կարապետյանի առաջարկը Հայոց ազգային արժանապատվության տրիբունալ ստեղծելու վերաբերյալ մասնագիտական քննարկումների լայն դաշտ է բացել իրավաբանների համար, որոնք չափազանց ուշագրավ հնարավորություն են տեսնում այդ տրիբունալի մեջ։
Հիշեցնենք՝ «Համահայկական ճակատ» կուսակցության հիմնադիր համագումարում Արշակ Կարապետյանն առաջարկեց ստեղծել Հայոց ազգային արժանապատվության տրիբունալ, որը դատական համակարգի լիակատար աղճատման պայմաններում կարող է աներկբա և անառարկելի վճիռ կայացնել գործող իշխանությունների՝ 44-օրյա պատերազմում և դրանից հետո կատարած հանցագործությունների և դավաճանությունների փաստով։
Արշակ Կարապետյանի առաջարկով տրիբունալի կազմում ընդգրկվելու են աշխարհի տարբեր երկրների անվանի հայ իրավաբաններ, պատմաբաններ և այլ ոլորտների անվանի մասնագետներ, որոնք այդ դատավարության ընթացքում հավաքելու, փաստագրելու և ներկայացնելու են գործող իշխանությունների կատարած հանցանքները և համապատասխան վճիռ են կայացնելու։
Ռուսաստանաբնակ բազմաթիվ իրավաբաններ մեր թղթակցի հետ զրույցում արձանագրում են, որ Հայոց ազգային արժանապատվության տրիբունալը կարող է դառնալ հանրային խորհրդի պես սահմանադրական մարմին և գումարվել խիստ անհրաժեշտության դեպքում։ Այդ կերպ տրիբունալի գոյության փաստը նաև հետագա իշխանություններին զգոն կպահի տարբեր հանցագործություններ կատարելու գայթակղությունից, որոնք կիմանան, որ սեփական երկրի ու պետության շահերի դեմ քայլեր կատարելու դեպքում տրիբունալը կարող է գումարվել և կարևորագույն վճիռներ կայացնել։
Չի բացառվում, որ արդեն իշխանափոխությունից՝ Նիկոլ Փաշինյանի և նրա թիմակիցների դատավճռից հետո Հայոց ազգային արժանապատվության տրիբունալը հենց նման մշտական մարմին դառնա։ Ուշագրավ է, որ այդ տրիբունալը նաև կարող է նախադեպային լինել աշխարհի տարբեր երկրների համար, որոնք այդ կերպ առանցքային կարևորության իրավական խնդիրներ լուծեն։
Իրանում, օրինակ, գոյություն ունի այսպես կոչված փորձագետների խորհուրդ, որոնք հավաքվում և ընտրում են երկրի առաջնորդին՝ այաթոլային։
Հայաստանը քրիստոնեական երկիր է և միաժամանակ սոցիալական ու իրավական պետություն, և իրավունքը պետք է գերակայի, իսկ իրավունքի գերակայության համար հարկավոր են իրավունքի երաշխավորներ։
