ՀՀ ՄԻՊ-ի աշխատակազմը մայիսի 9-ին աշխատելու է արտակարգ ռեժիմով

Հայաստանի Հանրապետության մարդու իրավունքների պաշտպան Անահիտ Մանասյանի հանձնարարությամբ ՄԻՊ աշխատակազմը մայիսի 9-ին աշխատելու է արտակարգ ռեժիմով՝ պայմանավորված հանրապետությունում տեղի ունեցող հավաքներով:
Շարունակվում են ինչպես լրատվամիջոցների և սոցիալական հարթակների մշտադիտարկումները, այնպես էլ ՄԻՊ աշխատակազմում ստացված ահազանգերի վերլուծությունը։
Մարդու իրավունքների պաշտպան Անահիտ Մանասյանն ընդգծում է, որ Հայաստանի Հանրապետությունում բոլոր իրադարձությունները պետք է զարգանան բացառապես ժողովրդավարական ճանապարհով՝ մարդու իրավունքների նկատմամբ անվերապահ հարգանքի ու համերաշխության պայմաններում՝ հիմքում ունենալով ժողովրդավարության արժեքներն ու իրավունքի գերակայության պահանջները:
Հավաքների ազատության իրավունքն ու դրա պատշաճ իրացումը ժողովրդավարական պետության կայացման անհրաժեշտ նախապայմաններից են:
Մարդու իրավունքների պաշտպանը ևս մեկ անգամ ընդգծում է, որ հավաքների ազատության հիմնարար իրավունքը վերաբերում է խաղաղ բնույթ ունեցող հավաքներին, իսկ խաղաղ հավաքների ազատությունը և հավաքների մասնակիցների անվտանգությունը երաշխավորելը պետության պարտավորությունն է:
Միևնույն ժամանակ, առանցքային է, որպեսզի հավաքի կազմակերպիչներն ու մասնակիցներն իրենց հերթին ապահովեն հավաքի խաղաղ ընթացքը, ցուցաբերեն զսպվածություն և պահպանեն օրենսդրությամբ սահմանված պահանջները: Դա վերաբերում է, այդ թվում` հավաքի ընթացքում բռնությունից, բռնության կոչերից, ատելության խոսքի դրսևորումներից զերծ մնալուն։
Մարդու իրավունքների պաշտպանի հաստատությանը մայիսի 9-ի հավաքին ընդառաջ ներկայացվել են հավաքների ազատության իրավունքի իրացմանն առնչվող տարատեսակ մտահոգություններ` կապված, այդ թվում` ոստիկանության կողմից ուժի գործադրման հավանականության, հավաքներին մասնակցությունը խոչընդոտելու, հավաքներին մասնակցությունը հարկադրելու, տեղի ունեցող գործընթացների շրջանակներում երեխաների լավագույն շահի ապահովման համատեքստում առկա խնդիրների վերաբերյալ։
Այս կապակցությամբ Պաշտպանը հատուկ ընդգծում է, որ անթույլատրելի է որևէ պարագայում Ոստիկանության ծառայողների կողմից անհամաչափ ուժի գործադրումը։ Ուժի կիրառումը հնարավոր է բացառապես օրենքով սահմանված հիմքերի առկայության դեպքում` համաչափությանը վերաբերելի չափանիշների պահպանմամբ։
Խիստ կարևոր է, որպեսզի երեխաների՝ հավաքներին ազատորեն մասնակցելու և այլ իրավունքների իրացման ընթացքում պետական իրավասու մարմինները, հավաքների կազմակերպիչները, մասնակիցները, զանգվածային լրատվության միջոցները և այլ դերակատարները առանցքային դիտարկեն երեխայի իրավունքների, այդ թվում` ցանկացած տեսակի բռնությունից զերծ լինելու, կրթության և այլ իրավունքների ապահովումը, ինչպես նաև երեխայի լավագույն շահը:
Պաշտպանն ընդգծում է նաև, որ անթույլատրելի է ինչպես հավաքներին մասնակցությունը խոչընդոտելը, այնպես էլ հավաքներին մասնակցելուն հարկադրելը։
Մարդու իրավունքների պաշտպանը ևս մեկ անգամ հորդորում է պետական իրավասու մարմիններին և հավաքի կազմակերպիչներին ու մասնակիցներին ապահովել հավաքի խաղաղ ընթացքը և ոլորտում առկա իրավական չափանիշները։
