Տրանսպորտի փոխադրավարձը որոշ դեպքերում կարող է սահմանվել առանց մրցույթի. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Տարածքային կառավարման և ենթակառուցվածքների նախարարությունը հանրային քննարկման է ներկայացրել «Կանոնավոր ուղևորափոխադրումների երթուղիների փոխադրավարձը սահմանելու պահանջները հաստատելու մասին» որոշման նախագիծը: 2023 թ. հուլիսի 12-ին ընդունված «Ավտոմոբիլային տրանսպորտի մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» ՀՕ-250-Ն օրենքի 11-րդ հոդվածի 12րդ մասի համաձայն՝ երթուղու սպասարկումն իրականացնելու համար սահմանված փոխադրավարձը կարող է վերանայվել օբյեկտիվ պատճառներով (դրամի արժեզրկում կամ արժևորում, վառելիքաքսուքային նյութերի, տրանսպորտային միջոցների և ավտոպահեստամասերի գների փոփոխություն և այլն):
Մրցույթի արդյունքով սահմանված փոխադրավարձը կարող է վերանայվել նաև մրցութային եղանակով կազմակերպված միասնական երթուղային ցանցերի առանձին երթուղիների ուղեգծերի փոփոխության դեպքում: Միասնական երթուղիների սպասարկման համար օպերատորի ընտրության մրցույթով չնախատեսված նոր երթուղիների ձևավորման դեպքում երթուղու փոխադրավարձը սահմանվում է տվյալ երթուղիները սպասարկող օպերատորի առաջարկությամբ, մրցութային հանձնաժողովի ներկայացմամբ և հաստատվում երթուղային ցանցը կազմակերպող համապատասխան մարմնի որոշմամբ։ Օրենքի կիրարկումն ապահովող ենթաօրենսդրական ակտը պետք է հաստատվի կառավարության որոշմամբ։ Կոտայքի և Արմավիրի մարզերում ներդրված միասնական երթուղային ցանցերի գործարկումից հետո անհրաժեշտություն է առաջանում վերանայելու կամ օպտիմալացնելու որոշ երթուղիների ուղեգծերը, որի դեպքում փոխադրավարձի սահմանման պահանջները կարգավորված չեն։
Միաժամանակ բացակայում է օրենքի 11-րդ հոդվածի 12-րդ մասով նախատեսված երթուղու սպասարկումն իրականացնելու համար սահմանված փոխադրավարձը օբյեկտիվ պատճառներով վերանայելու կարգավորումը։ Նախագծով առաջարկվում է վերանայել գործող կարգավորումը փոխադրավարձի բարձրացման մասով։ Մասնավորապես՝ միասնական երթուղային ցանցերի առանձին երթուղիների ուղեգծերի և սխեմաների փոփոխության դեպքում վերանայել փոխադրավարձը, կամ միասնական օպերատորի ընտրության մրցույթով չնախատեսված նոր երթուղիների ձևավորման դեպքում սահմանել փոխադրավարձը առանց մրցույթի։
Փոխադրավարձի փոփոխությունը կարող է վերանայվել մրցութային հանձնաժողովի ներկայացմամբ և հաստատվել երթուղային ցանցը կազմակերպող համապատասխան մարմնի որոշմամբ: Սահմանվում են նաև երթուղու սպասարկումն իրականացնելու համար սահմանված փոխադրավարձը օբյեկտիվ պատճառներով վերանայելու կարգավորումները։
