Երևանի ընդհանուր իրավասության դատարանի «Ավան» նստավայրում՝ նախագահությամբ դատավոր Հարություն Մանուկյանի, այսօր՝ հունիսի 3-ին, հրապարակվեց Ոստիկանության զորքերի նախկին հրամանատար, ոստիկանության պետի նախկին տեղակալ, գեներալ-լեյտենանտ Լևոն Երանոսյանի դատավճիռը։

Համաձայն մեղադրական եզրակացության՝ Լևոն Երանոսյանը հատուկ միջոցների գործադրմամբ դիտավորությամբ կատարել է այնպիսի գործողություններ, որոնք ակնհայտորեն դուրս են եկել իր լիազորությունների շրջանակից և էական վնաս են պատճառել քաղաքացիների իրավունքներին ու օրինական շահերին, ինչպես նաև անզգուշությամբ առաջացրել են ծանր հետևանքներ։

Երանոսյանին մեղադրանք է առաջադրվել ՀՀ ՔՕ 309 հոդվածի 1-ին մասի 2-րդ և 3-րդ կետերով և նրա նկատմամբ որպես խափանման միջոց է ընտրվել չհեռանալու մասին ստորագրությունը։ Երանոսյանին վերագրվող գործողությունները տեղի են ունեցել 2018 թվականի ապրիլի 16-ի և ապրիլի 22-ի բողոքի զանգվածային ակցիաների ժամանակ։ Նա չի ընդունում առաջադրված մեղադրանքը։

Դատարանը որոշեց 309-րդ հոդվածի 1-ին մասով (Պաշտոնեական լիազորություններն անցնելը) առաջադրված մեղադրանքը վերաորակել, նրա մեղավոր ճանաչել 375-րդ հոդվածի (Իշխանությունը չարաշահելը, իշխանազանցությունը կամ իշխանության անգործությունը) առաջին մասով նախատեսված հանցագործություն կատարելու համար և այդ մասով նրա նկատմամաբ քրեական հետապնդումը դադարեցնել՝ վաղեմության ժամկետն անցած լինելու հիմքով։

309 հոդվածի 2-րդ մասով առաջադրված մեղադրանքը նույնպես վերաորակվեց, ամբաստանյալը մեղավոր ճանաչվեց 375-րդ հոդվածի 2-րդ մասով նախատեսված հանցագործություն կատարելու համար, Երանոսյանի նկատմամաբ պատիժ նշանակվեց ազատազրկում՝ 4 տարի ժամկետով։ Սակայն դա էլ չի կիրառվի, քանի որ 2018-ին Էրեբունի-Երևանի հիմնադրման 2800-ամյակի և Հայաստանի առաջին հանրապետության անկախության հռչակման 100-ամյակի առթիվ Հայաստանի Հանրապետության Ազգային ժողովը հայտարարել էր համաներում, իսկ նշված հոդվածը նույնպես ընդգրկված է դրանում, Երանոսյանն ազատվեց նշանակված պատժից։

Նրա նկատմամաբ ընտրված «ստորագրություն՝ չհեռանալու մասին» խափանման միջոցը կպահպանվի՝ մինչև դատավճռի օրինական ուժի մեջ մտնելը։

Նշենք, որ դատավճիռը կարող է բողոքարկվել Վերաքննիչ քրեական դատարան՝ այն ստանալուց հետո 1 ամսվա ընթացքում։
