Կալանավորվել է Ջրականի 5-րդ ուսումնական գումարտակի սպա Հայկազ Գրիգորյանը

44-օրյա պատերազմի ժամանակ Ջրականի 5-րդ ուսումնական գումարտակի վաշտի հրամանատար, ապա շտաբի պետ, մայոր Հայկազ Գրիգորյանը կալանավորվել է։ Նրան մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 549-րդ հոդվածի 3-րդ մասով՝ իշխանազանցության կամ իշխանությունը չարաշահելու համար, որը անզգուշությամբ առաջացրել է մարդու առողջությանը ծանր վնասի պատճառում։
Այս մասին «Ինֆոքոմ»–ի գրավոր հարցմանն ի պատասխան՝ հայտնել են ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչությունից։
Հայկազ Գրիգորյանը, հիշեցնենք, այն սպաներից է, որի հետ 2020 թ․ հոկտեմբերի 10-ին Խուռհատ սարում անհաջող մարտական խնդրից հետո նորակոչիկների անձնակազմի մի մասը նահանջել է եւ կարողացել փրկվել։ Անձնակազմի մյուս մասը, պատշաճ չտեղեկացվելով, որ հակառակորդն արդեն Հադրութում է, գնացել է այդ ուղղությամբ եւ ընկել շրջափակման մեջ։
Խուռհատ սարում իշխանության անգործություն ցուցաբերելու եւ մարտի դաշտը ինքնակամ լքելու համար այժմ մեղադրվում է նույն գումարտակի հրամանատար Իշխան Վահանյանը։ Վերջինիս գործով քննության ժամանակ դեռ 2022 թ․ սեպտեմբեր ամսին Հայկազ Գրիգորյանը դատակոչվել էր դատարան՝ որպես վկա ցուցմունք տալու դեպքի իրեն հայտնի հանգամանքների վերաբերյալ։ Այդ ցուցմունքի հիման վրա էլ զոհված զինծառայողների ծնողների ներկայայցուցիչ փաստաբանները հանցագործության մասին հաղորդում էին ներկայացրել, ինչից հետո էլ 2022 թ․ նոյեմբերին, նախաձեռնվել էր այս քրեական վարույթը։
Գրավոր հարցմամբ Քննչական կոմիտեից խնդրել էինք հայտնել՝ Գրիգորյանից բացի այլ մեղադրյալներ կա՞ն, եթե այո, ինչո՞ւմ են մեղադրվում, եւ ի՞նչ խափանման միջոցներ են ընտրվել նրանց նկատմամբ։ Խնդրել էինք հայտնել նաեւ՝ հարցաքննվե՞լ են արդյոք նույն գումարտակի այլ սպաներ, եւ թե վարույթի շրջանակում քանի անձ է ճանաչվել տուժող, քանիսը՝ տուժողի իրավահաջորդ։
Քննչական կոմիտեից, սակայն, հայտնել են, որ այս հարցերը պարունակում են քրեական վարույթի հրապարակման ոչ ենթակա տվյալներ, ուստի, «Տեղեկատվության ազատության մասին» օրենքի համաձայն, չեն կարող տրամադրվել։
Նշենք, որ դատարանում ցուցմունք տալիս Հայկազ Գրիգորյանն ասել էր, որ երբ հոկտեմբերի սկզբին Իշխան Վահանյանին նշանակել են գումարտակի հրամանատար, իսկ իրեն՝ շտաբի պետ, ինքը շարունակել է վաշտի հրամանատարի գործառույթներն իրականացնել, քանի որ իր վաշտը հրամանատար չի ունեցել։ Ճշտող հարցին՝ բանակի հրամանատարի բանավոր հրամանն արդյո՞ք բավարար չէր շտաբի պետի պաշտոնը ստանձնելու համար, Գրիգորյանը պատասխանել էր, որ բավարար էր, այնուհանդերձ՝ հավելել․ «Շարունակել եմ պաշտոնավարել որպես վաշտի հրամանատար, ոնց կամ, մնացել եմ, ոչ մի փոփոխություն չեմ արել, ոչ ինչ–որ մեկն ասաց՝ մնացեք, ոչ ասաց՝ էդ պաշտոնը ստանձնի, ոչ մի բան չեն ասել»։
Գրիգորյանը պատմել էր նաեւ, որ Վահանյանի ենթադրյալ փախուստից հետո, երբ արդեն շրջափակման մեջ են ընկել, չեն իմացել՝ որ ուղղությամբ գնալ, եւ արդյունքում, 200 հոգանոց անձնակազմը բաժանվել է 3 խմբի․ ոմանք սխալ ուղղությամբ են գնացել, ինչի հետեւանքով հետագայում զոհվել կամ գերեվարվել են։ Դատավարության մասնակիցների հարցին, թե ներկա 4 սպաներով ինչո՞ւ չեն կանխել զորքի ցաքուցրիվ լինելը, վկան պատասխանել էր, որ իրավիճակն այնքան անկանոն էր, որ չեն կարողացել։
