18․06․2024թ․-ին Մարդու իրավունքների Եվրոպական դատարանը «Ա․Պ․-ն ընդդեմ Հայաստանի» գործով կայացրեց Վճիռ՝ արձանագրելով Մարդու իրավունքների և հիմնարար ազատությունների պաշտպանության մասին Եվրոպական կոնվենցիայով սահմանված խոշտանգման ենթարկվելու արգելքի, անձնական և ընտանեկան կյանքը հարգելու և իրավական պաշտպանության արդյունավետ միջոցի իրավունքների խախտումները։

«Ա․Պ․-ն ընդդեմ Հայաստանի» գործը վերաբերում է 14 տարեկան մտավոր խնդիրներ ունեցող երեխայի նկատմամբ հանրակրթական դպրոցի ուսուցչի(ով հանդիսանում էր նաև երեխայի բնակության վայրի գյուղապետը) կողմից դրսևորած սեռական բռնության դեպքին։ Գործի ներպետական քննության ժամանակ դատական տեղեկատվական համակարգում ամբողջությամբ հրապարակվել էր վերջինիս բոլոր անձնական տվյալները, ներառյալ՝ անուն-ազգանունը։ ՀՀ-ի կողմից ոչ նյութական վնասի որևէ փոխհատուցում այդպես էլ չեղավ, խախտվել էր Ա․Պ․-ի անձնական և ընտանեկան կյանքը հարգելու և իրավական պաշտպանության արդյունավետ միջոցի իրավունքը։

ՄԻԵԴ-ն արձանագրել է, որ տարիքի և հաշմանդամության հանգամանքով պայմանավորված երեխան գտնվել է հատկապես խոցելի վիճակում, ուստի պետությունից պահանջվող միջոցառումները պետք է առնվազն արդյունավետ պաշտպանություն ապահովեին և պետք է ներառեին ողջամիտ միջոցներ՝ կանխելու չարաշահումները, որոնց մասին իշխանությունները տեղյակ էին կամ պետք է տեղյակ լինեին:

Միաժամանակ, Դատարանն անդրադառնալով Ա․Պ․-ի արդարացի փոխհատուցման իրավունքին, արձանագրել է, որ թեև գործի ներպետական քննության ժամանակ արդեն իսկ ՄԻԵԴ-ը հրապարակել էր «Պողոսյանը և Բաղդասարյանն ընդդեմ ՀՀ-ի վճիռը», որով դատարանը անդրադարձել էր ոչ նյութական/բարոյական վնասի փոխհատուցման պարտավորությանը, այնուամենայնիվ, քննվող գործի շրջանակներում ներպետական դատարանները անձի՝ բարոյական վնասի փոխհատուցում չեն նախատեսել։

Դատարանի վճռով Հայաստանը պարտավորվել է Ա․Պ․-ին փոխհատուցել 32,000 եվրո։

Մարդու իրավունքների պաշտպանության և խախտված իրավունքների վերականգնման տեսանկյունից այս կարևոր գործի վերաբերյալ ՄԻԵԴ արտահայտած իրավական դիրքորոշման հիշատակմամբ ևս մեկ անգամ ընդգծենք ՀՔԱՎ գրասենյակի կողմից բազմիցս բարձրաձայնված այն հարցը, որ անձի խախտված իրավունքները կարող են համարվել ամբողջությամբ վերացված՝ ոչ միայն նյութական, այլև բարոյական վնասի փոխհատուցման տրամադրմամբ։ Ուստի ներպետական մակարդակում անհրաժեշտ է ապահովել խախտված իրավունքներով անձի արդարացի փոխհատուցում ստանալու հնարավորությունը։ Մինչդեռ այս պահին, նկարագրված դեպքից տասը տարի անց նույնպես, թեև «ոչ նյութական վնաս»-ը ամրագրվել է վնասների շարքում, այնուամենայնիվ, ՀՀ օրենսդրությամբ շարունակում են սահմանափակ թիվ կազմել այն իրավունքները, որոնց խախտումը ենթադրում է բարոյական վնասի փոխհատուցման հնարավորություն։ Այսպիսի մոտեցումը, խնդրահարույց լինելով մարդու իրավունքների պաշտպանության և խախտված իրավունքների վերականգնման տեսանկյունից, պահանջում է համակարգային փոփոխությունների իրականացման օբյեկտիվ անհրաժեշտություն։
