Ավարտվել է 2024թ. մայիսի 27-ին Երևան քաղաքի Աբովյան-Սայաթ-Նովա փողոցների խաչմերուկում «Տավուշը հանուն հայրենիքի» շարժման կողմից իրականացված անհնազանդության ակցիայի ժամանակ ծառայություն իրականացնող ոստիկանների նկատմամբ արցունքաբեր գազ կիրառելու և այդ կերպ վերջիններիս ծառայողական գործունեությանը խոչընդոտելու դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննությունը:

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Կենտրոն և Նորք-Մարաշ վարչական շրջանների քննչական երրորդ բաժնում իրականացված քննչական և վարութային գործողությունների արդյունքում ձեռք բերված փաստական տվյալներով հիմնավորվել է, որ 2024 թվականի մայիսի 27-ին՝ ժամը 10:30-ի սահմաններում, Երևան քաղաքի Աբովյան-Սայաթ-Նովա փողոցների խաչմերուկում մի շարք քաղաքացիներ իրականացրել են անհնազանդության ակցիաներ, որի ընթացքում արգելափակել են ճանապարհի երթևեկելի հատվածը: Նշված վայրում ծառայություն իրականացնող ՀՀ ՆԳՆ ոստիկանության տարբեր ստորաբաժանումների ծառայողներն ակցիայի մասնակիցներին ճանապարհի երթևեկելի հատվածը բացելու օրինական պահանջ են ներկայացրել, ինչը, սակայն, վերջիններիս կողմից չի կատարվել:

Երբ ՀՀ ՆԳՆ ոստիկանության պարեկային ծառայության աշխատակիցը մոտեցել է անհնազանդության ակցիա իրականացնող քաղաքացիներին և ցանկացել իր օրինական ծառայողական գործունեության շրջանակներում իրականացնել վարչական ձերբակալում, 54-ամյա տղամարդը, ով գտնվել է տվյալ տարածքում և, քննության տվյալներով, չի հանդիսացել անհնազանդության գործողություններ կատարող, ոստիկանի օրինական ծառայողական գործունեությանը միջամտելու նպատակով, հանել է իր մոտ պահվող արցունքաբեր գազաբալոնը և այն փչել ոստիկանության ծառայողի դեմքին՝ վերջինիս առողջությանը պատճառելով վնաս՝ այդ կերպ բռնություն գործադրելով նրա նկատմամբ:

Ձեռք բերված բավարար փաստերի հիման վրա 54–ամյա տղամարդուն մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 4-րդ մասի 2-րդ կետով: Նրա նկատմամբ որպես խափանման միջոց է կիրառվել կալանքը։

Նախաքննությունն ավարտվել է, քրեական վարույթի նյութերը, մեղադրական եզրակացությամբ, ուղարկվել են հսկող դատախազին՝ հաստատելու և դատարան ուղարկելու համար։

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
