Եկամտահարկի տարեկան հայտարարագիրը սահմանված ժամկետում չներկայացնելն առաջացնում է նախազգուշացում և տուգանք. ՊԵԿ

Պետական եկամուտների կոմիտեն տեղեկացնում է, որ ֆիզիկական անձանց 2023 թվականի եկամտային հարկի տարեկան հայտարարագրի ներկայացման ժամկետն ավարտվել է 2024 թ․ հուլիսի 22-ին։
Եկամտային հարկի տարեկան հաշվարկ-հայտարարագիրը սահմանված ժամկետում չներկայացնելու դեպքում սահմանված է վարչական պատասխանատվություն: Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 169․1 հոդվածի 3-րդ պարբերության համաձայն, առաջին անգամ չներկայացնելու դեպքում կիրառվում է նախազգուշացում վարչական տույժը։ Այնուհետև, նախազգուշացումը կիրառելուց հետո 30 օրվա ընթացքում հաշվարկ-հայտարարագիր չներկայացնելու դեպքում (նույն հոդվածի 4-րդ պարբերության 1-ից 4-րդ կետերի համաձայն) նախատեսվում է 50 հազար ՀՀ դրամի չափով տուգանք՝ ՀՀ ռեզիդենտ հանդիսացող ՀՀ քաղաքացիների համար, որոնք`
-հաշվետու տարվա դեկտեմբերի 31-ի դրությամբ հանդիսանում են (հանդիսացել են) դրան նախորդող տարվա արդյունքներով մեկ միլիարդ դրամ և ավելի համախառն եկամուտ հայտարարագրած ՀՀ ռեզիդենտ առևտրային կազմակերպության մասնակից (բաժնետեր փայատեր, անդամ),
-«Փողերի լվացման և ահաբեկչության ֆինանսավորման դեմ պայքարի մասին» ՀՀ օրենքի համաձայն համարվում են իրական շահառու,
-հաշվետու տարվա ընթացքում ստացել են 20 միլիոն դրամի չափով կամ ավելի փոխառություն։
Նշված խմբերում չներառված ֆիզիկական անձանց համար նախատեսվում է տուգանք՝ 5 հազար ՀՀ դրամի չափով։
Տուգանք վարչական տույժը կիրառելուց հետո, 30 օրվա ընթացքում տարեկան հաշվարկ-հայտարարագիրը չներկայացնելու դեպքում, տուգանքի չափը կրկնապատկվում է։
Հիշեցնենք, որ համաձայն Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի, վարչական իրավախախտում է համարվում մեղավոր (դիտավորյալ կամ անզգույշ) այնպիսի գործողությունը կամ անգործությունը, որի համար օրենսդրությամբ նախատեսված է վարչական պատասխանատվություն:
ՊԵԿ-ը միաժամանակ տեղեկացնում է, որ եկամտային հարկի տարեկան հաշվարկ-հայտարարագիր չներկայացնելու առթիվ հարուցված վարչական վարույթների շրջանակում, անձի մեղքի բացակայության մասին վկայող ապացույցներ ներկայացնելու դեպքում՝ ֆիզիկական անձը կարող է ազատվել վարչական պատասխանատվությունից։
