Ավազակություն կատարելու դեպքի առթիվ քննվող քրեական վարույթի շրջանակներում իրականացված քննչական և վարութային գործողությունների արդյունքում պարզվել են դեպքի մի շարք էական հանգամանքներ։

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Արաբկիր վարչական շրջանի քննչական բաժնում նախաձեռնված քրեական վարույթի նախաքննությամբ ձեռք բերված տվյալների համաձայն՝ 2024 թվականի հուլիսի 17-ին՝ ժամը 13։10-ի սահմաններում, Երևան քաղաքի Բաղրամյան պողոտայում գտնվող Կամոյի անվան դպրոցի մոտ վերոնշյալ կինը հանդիպել է իր նախկին ընկերոջը՝ 27–ամյա երիտասարդին։ Վերջինս, ընկերոջը զանգելու պատրվակով, վերցրել է կնոջ հեռախոսը։ Այնուհետև չվերադարձնելով հեռախոսը՝ քաշքշել է նրան և հարվածներ հասցրել ոտքին, ինչի հետևանքով վերջինս ընկել է գետնին, և պայուսակն ընկել է ձեռքից։ Նույն վայրում գտնվող մեկ այլ տղամարդ, վերցնելով պայուսակը, որի մեջ եղել են բանկային, նույնականացման քարտեր, այլ փաստաթղթեր և գումար, դիմել է փախուստի։ Վերջինիս բռնելու պատրվակով, կնոջ հեռախոսը ձեռքին, փախուստի է դիմել նաև 27–ամյա երիտասարդը։

Պարզվել է, որ 27–ամյա երիտասարդը, հեռախոսի միջոցով հասանելիություն ստանալով նրա անձնական և բանկային տվյալներին, կնոջ անվամբ, նույնականացման քարտի միջոցով, շուրջ 4,3մլն դրամի չափով առցանց վարկ է ձևակերպել և փորձել բանկային քարտից խոշոր գումարային փոխանցում կատարել մեկ այլ ֆիզիկական անձի բանկային քարտի, որը չի հաջողվել։ Իսկ վարկի տրամադրումը կասեցվել է տուժողի կողմից այդ ընթացքում կանխարգելիչ նպատակներով իր հաշիվներն արգելափակելու համար բանկ զանգահարելու արդյունքում։

Նախաքննության ընթացքում կատարվել է դեպքի վայրի զննություն, առգրավվել և զննության են ենթարկվել դեպքի վայրում առկա տեսանկարահանող սարքերը։ Տուժող կնոջ ստացած մարմնական վնասվածքների վերաբերյալ նշանակվել է դատաբժշկական փորձաքննություն։

Ձեռք բերված բավարար փաստերի հիման վրա 27–ամյա երիտասարդի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ ՀՀ քրեական օրենսգրքի 252-րդ հոդվածի 2-րդ մասի 3-րդ կետի, 456-րդ հոդվածի 2-րդ մասի 1-ին կետի և 44-255-րդ հոդվածի 2-րդ մասի 1-ին և 3-րդ կետերով։

Որոշում է կայացվել ազատության մեջ գտնվող 27–ամյա երիտասարդին ձերբակալելու մասին, որի կատարումը հանձնարարվել է ՀՀ ՆԳՆ ոստիկանությանը։
