Այսօր ՀՀ անկախության հռչակագրի ընդունման օրն է

Այսօր ՀՀ անկախության հռչակագրի ընդունման օրն է։ 1990թ․ օգոստոսի 23-ին Խորհրդային Հայաստանի Գերագույն խորհուրդը ընդունեց 12 կետերից կազմված փաստաթուղթը՝ այսպես սկիզբ դնելով Հայաստանի անկախության իրավական գործընթացին:
Փաստաթղթի ընդունմանը ԳԽ-ում նախորդել էին տևական քննարկումներն ու բանավեճերը։ Եւ Հռչակագիրն ընդունվեց ԳԽ-ում ներկայացված բոլոր ուժերի միջև բացարձակ կոնսենսուսի արդյունքում։
Հռչակագրի առաջին կետով Հայկական ԽՍՀ-ն վերանվանվեց Հայաստանի Հանրապետություն, կրճատ` Հայաստան, որը պետք է ունենար իր դրոշը, զինանշանը և հիմնը:
Երկրորդ կետն ասում էր, որ Հայաստանը ինքնիշխան պետություն է։
Հինգերորդ կետում նշված է, որ Հայաստանի Հանրապետությունը իր անվտանգությունը և սահմանների անձեռնմխելիությունը ապահովելու նպատակով ստեղծում է Գերագույն խորհրդին ենթակա սեփական զինված ուժեր, ներքին զորքեր, պետական և հասարակական անվտանգության մարմիններ։
Հռչակագրի վեցերորդ կետում սահմանված է, որ Հայաստանը, որպես միջազգային իրավունքի սուբյեկտ, վարում է անկախ արտաքին քաղաքականություն, անմիջական հարաբերություններ է հաստատում այլ պետությունների, ԽՍՀՄ ազգային-պետական կազմավորումների հետ: էլի Ռադարի նյութն ենք գողացել առանց հղման
Հռչակագրի ամեն մի կետը ընդունվել է առանձին քվեարկությամբ:
Սակայն ամենաշատ բանավեճը ծավալվեց թե արդյո՞ք պետք է՞ Հայոց ցեղասպանության խնդիրը տեղ գտնի իրավական փաստաթղթում:
Խորհրդարանի նախագահ Լևոն Տեր-Պետրոսյանն ու իր քաղաքական թիմը՝ ՀՀՇ-ն համարում էին, որ քաղաքական և դիվանագիտական տեսանկյունից ցեղասպանության հարցը Անկախության Հռչակագրում դնելը ճիշտ չէ և որ դրան կարելի է մեկ այլ փաստաթղթում անդրադառնալ: Սակայն քանի որ պատգամավորների մեծամասնությունը կողմ էր այդ դրույթին։ ՀՀՇ-ն տեղի տվեց այդ պահանջին, սակայն քաղաքականապես նուրբ ձևակերպմամբ. Փաստաթղթում ասվում է. Հայաստանը սատար է կանգնում 1915թ. Օսմանյան Թուրքիայում և Արևմտյան Հայաստանում Հայոց ցեղասպանության միջազգային ճանաչման գործին:
Այնուամենայնիվ, այդ կետը Հռչակագրում ընդգրկելուն դեմ քվեարկեց 25 պատգամավոր:
Հռչակագրի վերջին՝ 12-րդ կետն ասում էր, որ այս փաստաթուղթը հիմք է ծառայում Սահմանադրության մշակման, իսկ գործող Սահմանադրության մեջ՝ փոփոխությունների և լրացումների կատարման, պետական մարմինների գործունեության, հանրապետության նոր օրենսդրության մշակման համար:
Հայաստանի անկախության մասին հռչակագիրը Հայաստանի Հանրապետության հիմնադիր փաստաթուղթն է։ Եւ սա հիմք դարձավ արդեն 1991թ. սեպտեմբերին անցկացնելու համաժողովրդական հանրաքվե։
