Ամուսնության նպատակով առևանգել է աղջկան, կամքին հակառակ տեղափոխել այլ վայր

Հակոբ Մ.-ն 2024 թվականի ապրիլի 12-ին ընկերոջ՝ Ազատ Տ․-ի և քրոջ ամուսնու՝ Արտեմ Բ․-ի հետ միասին նախապես պայմանավորվելով հանցանքը՝ Սոֆյա Օ․-ի` ամուսնության նպատակով առևանգումը համատեղ կատարելու մասին, նույն օրը՝ ժամը 11:30-ի սահմաններում, Արտեմ Բ․-ի վարած «Օպել» մակնիշի ավտոմեքենայով մեկնել են Սյունիքի մարզի Գորիս համայնքի տներից մեկի մոտ։
Դրանից հետո՝ Սոֆյա Օ․-ի կամքին հակառակ առևանգել են նրան, մասնավորապես՝ Ազատ Տ․-ն և Հակոբ Մ․-ն գրկել են նրան, ապա Հակոբ Մ․-ն փակել է նրա բերանը, իսկ Ազատ Տ․-ն բաց է պահել ավտոմեքենայի դուռը, և միասին նրան նստեցրել են Արտեմ Բ․-ի վարած հիշյալ ավտոմեքենան։
Անտեսելով Սոֆյա Օ․-ի՝ իրեն տուն տանելու պահանջները, կամքին հակառակ տեղափոխել են այլ վայր՝ Սյունիքի մարզի Տաթև համայնք։

Գործը դատարան է ստացվել մայիսի 2-ին և մակագրվել է դատավոր Ռիմա Առաքելյանին։
Մեղադրյալ Արտեմ Բ․-ի նկատմամբ որպես խափանման միջոց էր ընտրվել կալանքը։ Դատարանի որոշմամբ խափանման միջոցը փոխվել էր, և ընտրվել էր բացակայելու արգելքը։
Մեղադրյալ Հակոբ Մ․-ի նկատմամբ ևս կիրառվել էր կալանքը։ Դատարանի որոշմամբ վերջինիս նկատմամբ նույնպես ընտրվել էր բացակայելու արգելքը։
Մեղադրյալ Ազատ Տ․-ի նկատմամբ որպես խափանման միջոց կիրառված բացակայելու արգելքը թողնվել է անփոփոխ:
Մայիսի 13-ին դատարանը հրապարակել է դատավճիռը։ Հակոբ Մ․-ին մեղավոր է ճանաչվել հանցանքի կատարման մեջ և նրա նկատմամբ պատիժ է նշանակել ազատազրկում 4 տարի ժամկետով:
Հակոբ Մ․-ի նկատմամբ նշանակված պատժին հաշվակվցել է նրա փաստացի անազատության մեջ գտնվելու՝ 1 ամիս ժամկետը և վերջնական պատիժ է նշանակել ազատազրկումը՝ 3 տարի 11 ամիս ժամկետով։
Ամբաստանյալի նկատմամբ ազատազրկման ձևով նշանակված պատիժը պայմանականորեն չի կիրառվել` սահմանելով փորձաշրջան 2 տարի ժամկետով՝ վարքի նկատմամբ վերահսկողությունը դնելով Հակոբ Մ․-ի բնակության վայրի ՀՀ արդարադատության նախարարության պրոբացիայի ծառայության ստորաբաժանման վրա։
Արտեմ Բ․-ն և Ազատ Տ․-ն նույնպես մեղավոր են ճանաչվել, սակայն նրանց նկատմամբ նույնպես պատիժը պայմանականորեն չի կիրառվել։
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
