ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում նախաձեռնված քրեական վարույթի շրջանակներում ի հայտ են բերվել ՀՀ Լոռու մարզի Օձուն համայնքում 2018-2020թթ. կատարված առերևույթ պաշտոնեական հանցագործության դեպքեր։

Մասնավորապես, նախաքննությամբ իրականացված վարութային և ապացուցողական գործողություններով պարզվել է, որ Օձուն համայնքի՝ տեղական ինքնակառավարման մարմնում մշտապես իշխանության ներկայացուցչի, ինչպես նաև համայնքապետարանում կազմակերպական-տնօրինչական գործառույթներ իրականացնող պաշտոնատար անձը, ունենալով համայնքապետարանի աշխատանքերը ղեկավարելու և կազմակերպելու, համայնքի ավագանու համաձայնությամբ և սահմանած պայմաններով ու կարգով համայնքի սեփականություն համարվող հողամասերն օտարելու կամ օգտագործման տրամադրելու պարտականություններ, մի շարք իրավական ակտերի պահանջների խախտմամբ օտարել է օրենսդրությամբ սահմանված կարգով մասնավորեցման ոչ ենթակա 2 հողատարածք:

Նախ՝ նշված պաշտոնատար անձի որոշմամբ, ուղղակի վաճառքով, համայնքի մի բնակչի 2018թ. մայիսին 20.178 դրամով օտարվել է 0,0059 հա մակերեսով, իսկ 2020թ. փետրվարին՝ 10.000 դրամով 0,0029 հա մակերեսով բնակավայրերի նպատակային նշանակության՝ հասարակական կառուցապատման գործառնական նշանակության հողամասեր, որոնց նկատմամբ գրանցվել է վերջինիս սեփականության իրավունքը:

Մինչդեռ քննությամբ պարզվել է, որ երկու հողամասերն էլ պետության կողմից սեփականության իրավունքով համայնքին են փոխանցվել՝ որպես չմասնավորեցվող փողոց-հրապարակ, և, հետևաբար, դրանք, համաձայն ՀՀ հողային օրենսգրքի համապատասխան իրավակարգավորումների, ունեն օտարման արգելք։

Ձեռք բերված փաստերի հիման վրա Օձուն համայնքի՝ տեղական ինքնակառավարման մարմնում մշտապես իշխանության ներկայացուցչի գործառույթներ իրականացնող նշված պաշտոնատար անձի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ ՀՀ նախկին քրեա¬կան օրենսգրքի 308-րդ հոդվածի 1-ին մասով (համապատասխանում է ՀՀ գործող քրեական օրենսգրքի 441-րդ հոդվածի 1֊ին մասին):

Նրա նկատմամբ որպես խափանման միջոց է ընտրվել բացակայելու արգելքը։
